§ 75.05 NOTICE OF ABANDONED VEHICLE.
   (A)   Before an abandoned vehicle that is not a traffic hazard or is not impeding traffic may be towed, notice must be given to the owner of the vehicle. When the City Police Department does not know the identity of the registered owner of a licensed vehicle, the City Police Department shall cause the vehicle registration records of the State of Illinois to be searched by the Secretary of State for the purpose of determining the owner of the vehicle. Once the identity of the owner has been determined, the City Police Department shall, within 24 hours, notify the owner by certified mail that the vehicle is subject to being towed as an abandoned vehicle and notify the owner of the legal and factual basis for the presumption of abandonment. The notice to the owner shall also advise the owner that the vehicle will be towed 7 days after the date of the notice, unless the vehicle is moved by the owner within that time or the owner requests a hearing as set forth in § 75.06.
   (B)   The notice required by this paragraph shall not apply to vehicles that do not carry current license plates. As to those vehicles, a notice of abandonment and the earliest tow date shall be affixed to the windshield of the vehicle.
   (C)   Abandoned, unattended, wrecked, burned, or partially dismantled vehicles that create a traffic hazard because of their position in relation to the highway or cause the impediment of traffic may be towed without notice.
