§ 96.01 FIRE PREVENTION CODE ADOPTED BY REFERENCE; EXCEPTIONS THERETO.
   (A)   The Fire Prevention Code, published and known as the Ohio Fire Code, as the same is constituted on the effective date of this section and as the same may be hereafter amended or recodified, is incorporated herein by reference as if set out at length and verbatim herein, and is, as so incorporated, hereby adopted and promulgated by reference and established as the Fire Prevention Code of the municipality, applicable and controlling, in all its provisions, within the municipality, to the inhabitants of the municipality, to the property now and hereafter located, and all construction performed, within the municipality, and to the use of all such property, save and except such portions of such Code so adopted as are hereinafter modified.
   (B)   A person may use or allow to be used an open flame, burning candle(s) or other devices in connection with any public or private gathering for purposes of worship, instruction, education or similar purpose in places of public assembly or education, such as churches, schools, and lodges, so long as the following precautions are strictly adhered to:
      (1)   Stationary open flames may not be used in any aisle or exit, provided that open flames being utilized in a moving procession are not prohibited. Stationary flames may be affixed to the end of a pew or mounted at the side of an exit so long as they do not impair or impede ingress and egress.
      (2)   Open flames may not be used by anyone under the age of 16 without the supervision of an adult.
      (3)   Open flames must be used only in such a manner as to avoid ignition of combustible materials or injury to occupants.
      (4)   Non-combustible containers for disposal of the open flame, candle, or other device must be provided.
   (C)   Open flames, burning candle(s), or other device(s) not specifically permitted in division (B) may be approved by the Code official, who shall base his determination on the reasonable standards required to safeguard life and property from the hazards of fire and explosion.
