§ 94.14 SIDEWALK CONSTRUCTION SPECIFICATIONS: CONDEMNATION.
   (A)   All sidewalks constructed or reconstructed in the municipality in any public right-of-way shall be installed in conformity with the latest edition of the Ohio Department of Transportation Construction and Material Specifications, as amended, all state and federal regulations governing handicap design, accessibility and use, and with the supplemental City of Montgomery construction standards hereinafter set forth.
   (B)   As employed herein SIDEWALKS shall include: concrete walks and bikeways, handicapped ramps, bituminous walks and bike-ways, entrance pavements, driveway entrances, concrete and bituminous surfaces, commercial and residential applications, and areas where paving brick is used or prescribed.
   (C)   The supplemental City of Montgomery Construction standards are as follows:
      (1)   Concrete sidewalks installed pursuant to this section shall be a minimum five feet wide, five inches thick, Class C concrete. The sidewalk thickness at a residential driveway entrance shall be seven inches, and at commercial entrances the concrete shall be reinforced with steel as directed by the city.
      (2)   The thickness of handicapped ramps adjoining street curbs, shall be 12 inches, and the minimum width parallel to the curb shall be 12 inches.
      (3)   Bituminous sidewalk (when permitted) shall conform to all applicable paving standards, with a compacted thickness of five inches of asphalt and a minimum of eight inches when sidewalks are an integral part of the street or highway.
      (4)   The subgrade to any type of sidewalk shall conform to the requirements provided for streets and highways. The use of fill and embankment shall meet ODOT standards.
      (5)   Paving brick, block and tile-type sidewalks (when permitted) shall conform to Ohio and Montgomery standards and to the manufacturer's specifications.
      (6) All sidewalks shall conform to the stormwater control requirements imposed by the city.
      (7)   Sidewalk construction in the Heritage Overlay District must conform to the Streetscape Master Plan. See § 151.1405.
   (D)   Condemnation. The following sidewalks, or parts of sidewalks, now or hereafter existing shall be condemned:
      (1)   Any block, stone, brick, or segment thereof having a crack in it more than 5/8 of an inch wide at the surface.
      (2)   Adjoining blocks, stones, bricks, or portions thereof whose adjacent edges differ in vertical elevation by more than 5/8 of an inch.
      (3)   Blocks, stones, or bricks that have holes in them 5/8 of an inch or more in diameter or that are broken so that substantial fragments are missing or loose.
      (4)   Blocks, stones, or bricks having depressions such as to impound mud or water.
      (5)   Blocks, stones, or bricks having a cross slope away from the street in excess of 3/4 of an inch vertical per one foot horizontal.
      (6)   Blocks, stones, or bricks that are very rough, with the course aggregate protruding, by reason of ravelling or spalling.
