(A) In accordance with the provisions of this Chapter 51, the Public Works Director may promulgate administrative rules and regulations, as the Public Works Director deems appropriate, to carry out the express purposes and intents of this chapter.
(B) Such rules and regulations shall not materially increase the obligation of any provider hereunder, provided however that:
(1) The adoption of rules and regulations increasing fees; or
(2) The requiring of the placement of facilities in designated portions of the rights-of-way, underground; or,
(3) The requiring of:
(a) The overbuilding of facilities; or,
(b) Joint builds shall not be construed as materially increasing the obligation of a provider; and,
(4) The Public Works Director may develop and implement rules and regulations by filing same with the Clerk of Council for publication. The Clerk shall file a copy of the proposed rules with the Public Works Committee of Council. The Clerk shall publish notice in a newspaper of general circulation in the community one day each week for two consecutive weeks, notifying the general public on the time, date and place of the meeting of the Public Works Committee when such rules will be reviewed and that a copy of such proposed rules is available for inspection at the Office of the Clerk during regular business hours. The first publication shall occur no less than three weeks prior to the meeting of the Public Works Committee when such rules will be considered. The proposed rules shall then become effective 30 days after approval by the Public Works Committee of Council.
