11-12-1: STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOSE:
   A.   Statutory Authorization: The legislature of the State of Minnesota has, in Minnesota Statutes chapter 103F and section 462.357 delegated the responsibility to local government units to adopt regulations designed to minimize flood losses. Therefore, the City Council does ordain as follows.
   B.   Findings Of Fact:
      1.   Periodic Inundation: The flood hazard areas of Montevideo, are subject to periodic inundation which results in potential loss of life, loss of property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare.
      2.   Methods Used To Analyze Flood Hazards: This Chapter is based upon a reasonable method of analyzing flood hazards which is consistent with the standards established by the Minnesota Department of Natural Resources.
   C.   Statement Of Purpose: It is the purpose of this Chapter to promote the public health, safety and general welfare and to minimize those losses described in subsection B1 of this Section by provisions contained herein. (Ord. 660, 9-18-1989)
