9-3-1: DEFINITIONS:
For purposes of this chapter, the following capitalized terms shall have the following meanings:
CITY: The city of Montevideo, county of Chippewa, state of Minnesota.
CITY UTILITY SYSTEM: Facilities used for providing public utility service owned or operated by city or agency thereof, including, but not necessarily limited to, sewer, storm sewer, water service, street lighting; traffic signals and telecommunications, but excluding facilities for providing heating, lighting, or other forms of energy.
COMMISSION: The Minnesota public utilities commission, or any successor agency or agencies, including an agency of the federal government that preempts all or part of the authority to regulate gas retail rates now vested in the commission.
COMPANY: Great Plains Natural Gas Co., a division of MDU Resources Group, Inc., a Delaware corporation, its successors and assigns, including all successors or assigns that own or operate any part or parts of the gas facilities subject to this franchise.
EFFECTIVE DATE: The date on which this chapter becomes effective under subsection 9-3-2B of this chapter.
ENGINEER: The Montevideo city engineer, or his or her designee.
GAS: Natural gas, manufactured gas, mixture of natural gas and manufactured gas or other forms of gas energy.
GAS FACILITIES: Gas transmission and distribution pipes, mains, lines, ducts, fixtures and all necessary facilities, equipment and appurtenances owned or operated by the company or its agents for the purpose of providing gas energy for public or private use.
NOTICE: A writing served by a party or parties on another party or parties. Notice to company, when required, must be mailed to 705 West Fir Avenue, P.O. Box 176, Fergus Falls, MN 56538-0176. Notice to city, when required, must be mailed to 103 Canton Avenue, P.O. Box 517, Montevideo, MN 56265. Any party may change its respective address for the purpose of this chapter by written notice to the other party.
PUBLIC GROUND: Land owned or otherwise controlled by the city for parks, open space or similar public purpose which is held for use in common by the public.
PUBLIC WAY: Any street, alley or other public right of way within the city.
RIGHT OF WAY PERMIT: The permit required by this chapter and issued pursuant to city's permit ordinance. (Ord. 922, 11-5-2012)
