8-4-39: SERVICE LINES:
All water service lines and all sanitary sewer service lines shall be owned and all expenses of maintaining, repairing and replacing the same shall be paid by the owners of the property served for whose benefit the same were installed, whether such installation is by the city or by those benefited. All such water and sanitary sewer service lines shall be installed at a sufficient depth to avoid freezing. All new connections (or disconnections) to the mains shall be at the expense of the property owner. In areas where water or sewer service line stubs/curb boxes have been installed, the owner of the property being served may connect to those lines or stubs, but the city neither guarantees their location or state of repair. All initial costs to connect water and sewer service lines to the main are at the cost of the property owner, including connections to previously installed stub lines.
   A.   Water Service Line Defined: A "water service line" is any line which connects the city main to the property being served. Once installed at cost to the property owners, ownership and maintenance of the water line is defined as:
      1.   Property Owner Owns And Maintains: From the property side of the curb box (shutoff), including the flare and nut connection to the curb box, to the house or business being served. This includes valves, meter valves, sprinkler systems and appurtenances such as backflow preventers and pressure reducers, whether or not installed by the city. The property owner is also responsible to repair frozen water lines from the house to the main.
      2.   City Owns And Maintains: The water service lines from the curb box (shutoff) to the main. The city shall also own all city installed unused stubs or water service line extensions, up to and including the curb box.
      3.   Abandoned Lines: Property owners who abandon or no longer need the use of a service line must pay the full cost of the abandonment or disconnection of the line, including all costs to remove the line, up to the main, if so directed by the city. These costs include all costs to repair the right of way, curbs, sidewalks and streets. Once correctly abandoned, under the direction of the city, the city will take ownership of the remaining stub, shutoff or line, if left in place at the direction of the city.
   B.   Sanitary Sewer Service Line Defined: A "sanitary sewer service line" is any sanitary sewer line which is less than eight inches (8") in diameter and also includes any sanitary sewer line which is eight inches (8") or more in diameter where such size is made necessary to provide service to a particular individual or individuals and is not an extension of the City sanitary sewer.
