8-4-38: CONNECTION CHARGE:
   A.   Flexibility In Application: Whenever the city council determines that a special assessment is not practical or feasible or will be inequitable and will not fairly represent the benefits to the property to be served with water or sanitary sewer, or that a connection charge in lieu of a special assessment will more accurately reflect the benefits to be received by the property to be served with water or sanitary sewer, the city council may by resolution provide that a connection charge be paid for providing water or sanitary sewer service to any property.
   B.   Content Of Resolution: Any such resolution shall fix the amount of the connection charge to be paid and shall describe the property to be benefited thereby.
   C.   Method Of Payment: Any such connection charge so imposed shall be assessed and may be paid in the same manner as special assessments for local improvements are assessed and paid.
   D.   Additional Charges Possible: Any such connection charge shall be in lieu of any special assessment against the property benefited for the service for which the connection charge is made, and no property for which a connection charge has been paid shall be assessed otherwise for the same service, but this shall not prevent additional connection charges being made for additional connections to the water or sanitary sewer lines to provide additional services to the same property.
