8-4-36: USE OF PUBLIC SEWERS:
   A.   Unlawful Discharges: No person shall discharge or cause to be discharged directly or indirectly any stormwater, surface water, ground water, roof runoff, subsurface drainage waste from on site disposal systems, unpolluted cooling or process water into the sanitary sewer collection system. No roof, sump pump, swimming pool discharge, or surface or subsurface water drainage system shall be connected to the sanitary sewer system, and no building shall hereafter be constructed, nor shall an existing building be hereafter altered in such a manner so as to provide such connection with the sanitary sewer system, either inside or outside the building, except as herein provided.
   B.   Deadline For Removal Of Illegal Connections: Before July 15, 1998, any person having a roof, sump pump, swimming pool discharge, or surface or subsurface drainage system now connected and/or discharging into the sanitary sewer, shall disconnect and/or remove the same. Any disconnects or openings in the sanitary sewer shall be closed and repaired in an effective, workmanlike manner, as approved by the city.
   C.   Inspection Rights Of City: The owner of such property shall allow employees of the city or its agents to inspect the buildings to confirm compliance with the provisions hereof, or such owner may alternatively furnish a certificate from a licensed plumber certifying that their property is in compliance with this section in lieu of a city inspection of the same. Any person refusing to allow their property to be inspected, or refusing to provide a plumber's certificate of compliance within fourteen (14) days of the date a city employee or agent is denied admittance to inspect the property, shall be deemed to be in violation of this section, said violation to constitute a misdemeanor.
   D.   Penalty Surcharge Imposed: A monthly surcharge set by resolution of the council is hereby imposed and added to every sewer billing mailed on or after January 1, 1999, to property owners who are not in compliance with this subsection. The surcharge shall be added every month until the property is in compliance.
   E.   Exceptions: Notwithstanding anything to the contrary herein, upon application to the city, a property owner, in the sole discretion of the city upon showing of undue hardship, may be granted authorization to discharge contrary to the terms hereof during the months of December, January, February and March.
   F.   Implementation: The city may establish regulations for the implementation of this section. Such regulations shall be effective upon approval by the city council and publication in the official newspaper. (Ord. 780, 5-6-1997)
