Any person having a contract with the City for laying, relaying or repairing sewers, water pipes or setting hydrants, shall have the right to excavate in the streets or alleys for the purpose of laying such water mains or sewers as may be provided for or needed in the completion of such contract without a permit from the City; provided, such contract shall provide for indemnifying the City against any lesser damage caused by neglect or carelessness on the part of the contractor, his or her agents, employees or servants in the progress of work done by virtue of said contract.
