7-7-5: SALE OF CEMETERY LOTS:
The cemetery lots which the Council shall deem advisable to offer for sale, shall be listed and appraised by said Council, and when the amount of such appraisal shall have been paid into the City Treasury, and a duplicate receipt thereof filed with the Clerk, the Mayor and City Manager shall execute a deed, attested to by the City Clerk, to the purchaser. Said deed shall be for "the purpose of interment only", and shall be drawn subject to all the laws, rules and regulations of the City now or hereafter in force. No title to any cemetery lot or portion thereof, shall be transferred by the owner thereof except as authorized by Minnesota Statutes section 306.29. Whenever the title to any cemetery lot, or portion thereof, shall be transferred by the owner thereof, the City shall have the right to repurchase the same by paying to such owner the price originally paid to the City therefor, less the portion thereof allocated to the Permanent Care and Improvement Fund under section 7-7-10 of this chapter; provided, however, that this right of repurchase by the City shall not apply when a conveyance is made to the City for the purpose of transferring title to a spouse, sister or brother of the owner, or to a descendant of the owner or a descendant of the owner's spouse, sister or brother.
