Any person violating the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1-4-1 of this code, or the court, in its discretion, may provide for the impounding of the all-terrain vehicle which has been operated in violation of this chapter for not to exceed thirty (30) days.
