4-2-6: RULES AND REGULATIONS:
   A.   Council Authority; Licensing Of Collectors: The council may make, by resolution, such administrative regulations and rules as may be necessary and proper to regulate, enforce and carry out the provisions of this chapter. The council may as they deem it necessary, license a person or persons to collect, remove and haul garbage and rubbish from premises within the city to a place of disposition operated according to applicable rules and regulations and the laws of the state.
   B.   Application For License; Requirements: Any person or persons desiring a license as such garbage and rubbish collector shall file an application therefor in writing with the clerk, which application shall state the applicant's name, age and residence, the type of equipment to be used in collecting, hauling and removing such garbage and rubbish, and a schedule of rates to be charged for such service. The council may require of such applicant as a condition to the issuance of such license that the applicant furnish a bond in an amount to be determined by the council, for the performance of such service in accordance with the provisions of this code and the rules and regulations of the board of health and may also require such garbage and rubbish collector to have and file with the clerk public liability and property damage insurance in such sums as the council shall determine. In the event that there shall be no licensed garbage and rubbish collector, the city may cause such garbage and rubbish to be collected and removed, and make such charges for such services as shall be determined by the council to be reasonable. No person or agent or employee thereof shall collect or remove any garbage and rubbish or haul or transport the same over the streets, alleys or public places of the city except a licensed garbage and rubbish collector or the municipal garbage and rubbish collector.    C.   Rental Residences: The following provisions shall apply to nonowner occupied residences:
      1.   Every occupant of a rental unit shall store and dispose of all garbage, refuse, and any other organic waste which might provide food for insects and/or rodents in a clean, sanitary, and safe manner.
      2.   All garbage cans and refuse containers shall be ratproof, insectproof, watertight, structurally strong to withstand handling stress, easily filled, emptied, and cleaned; shall be provided with tight fitting covers or similar closures; and shall be maintained at all times in a clean, sanitary condition. Plastic bags may be used as garbage and refuse container liners, but shall not be used without the container for on site storage of garbage or refuse. (Ord. 824, 5-6-2002)
