§ 153.039 EFFECTIVE DATE OF PRIMARY APPROVAL.
   The primary approval shall be effective for a period of 3 years after the date of primary approval, at the end of which time secondary approval of the subdivision or any section thereof must have been obtained. Any subdivision not receiving secondary approval within the period of time set forth herein shall be null and void, and the developer shall be required to resubmit a new primary application for review and approval subject to all the zoning restrictions and subdivision regulations in effect at the time of resubmission. Upon written request from the applicant, the Commission may extend the primary approval for 2 years beyond the expiration date without further public notice and public hearing. Request for extension must be received no less that 90 days prior to expiration of primary approval.
