909.07 APPLICATION FOR VARIANCE.
   (a)   The Zoning Administration Board of Appeals shall hear requests from property owners for variances from the duties to construct sidewalks imposed by this Section. Variance applications must be filed within thirty (30) days from receipt of the inspection notice. The Zoning Administration Board of Appeals may grant variances either modifying or postponing the obligation imposed by this Section up to a period of ten (10) years where:
      (1)   The character of the neighborhood is such that the installation of sidewalks would not serve any public purpose; or
      (2)   Where unique physical conditions make the installation of sidewalks an undue hardship, and the absence of this installation would not materially affect the public’s safety and convenience.
   (b)   In granting a variance, the Board may attach any such reasonable conditions and safeguards as it deems necessary to protect the public’s safety and convenience, including the requirement that a bond be posted where appropriate.
