(a) Every person, being the owner or agent of any lot or parcel of land fronting on any street, avenue or public grounds of the Municipality, in front of which trees are planted and growing, shall keep such trees trimmed so as not to obstruct the passage of light from any street lamp or arc light in the vicinity. Each owner or agent shall keep all trees trimmed so that all branches overhanging streets and pavements shall be not less than fourteen feet above the surface of such street or pavement and not permitted to extend over any street or highway in such a manner as to obstruct the free use of such street or highway, nor annoy and inconvenience any resident.
(b) If any owner or agent of any lot or parcel of land as stated in subsection (a) hereof fails or refuses to comply with any of the requirements of this section, it shall be the duty of the Superintendent of Streets to cause such trimming to be done and to certify to Council a bill of the cost and expense. The cost shall be placed upon the tax duplicate by the Clerk-Treasurer.
