509.08 CURFEW.
   (a)   No child under the age of eighteen years shall be outside the confines of his homesite and congregate, wander, loiter or play upon the streets or other public places of the Municipality, unsupervised or unenclosed lands or places of amusement and entertainment, between the hours of 11:00 p.m. and 5:00 a.m.
   (b)   No person having the control and custody of or being the parent or guardian of a minor shall knowingly permit such minor to be outside the confines of his homesite and to congregate, wander, loiter or play upon the streets or other public places of the Municipality, unsupervised or unenclosed lands or places of amusement and entertainment, in violation of subsection (a) hereof, unless such person accompanies the minor in the public place or place of amusement and entertainment.
   (c)   The provisions of subsection (a) hereof shall not apply to minors accompanied by a parent, guardian or member of the minor’s immediate family who is eighteen years of age or older.
   (d)   The provisions of subsections (a) and (b) hereof shall not apply to minors engaged in lawful employment requiring them to be upon the streets or other public places of the Municipality, unsupervised or unenclosed lands or places of amusement and entertainment during such prohibited hours while so lawfully employed. Nor shall the provisions of such subsections apply to minors returning directly home from school activities held at any of the Municipal schools under the supervision of the local school board and its employees.
   (e)   Whoever violates subsection (a) hereof shall be apprehended and charged as being an unruly child and taken before the Huron County Juvenile Court as provided in Ohio R.C. Chapter 2151. Whoever violates subsection (b) hereof is guilty of a misdemeanor of the fourth degree.
