133.05 PROCEDURE FOR SALES BY INTERNET AUCTION.
   (a)   Pursuant to Ohio R.C. 721.15(D), regardless of the property's value, Council may sell personal property acquired for the use by municipal employees and departments and which is no longer needed for public use, or is obsolete or unfit for the use for which it was acquired, by internet auction.
   (b)   Council shall adopt, during each calendar year, legislation expressing its intent to sell property by internet auction. The legislation shall include a description of how the auctions will be conducted and shall specify the number of days for bidding on the property, which shall be no less that ten days, including Saturdays, Sundays, and legal holidays. The legislation shall indicate whether the Village will conduct the auction or Council will contract with a representative to conduct the auction. The legislation shall also establish the general terms and conditions of the sale. If a representative is known when the legislation is adopted, the contact information shall be provided in the legislation.
   (c)   After adoption of the legislation, Council shall publish, in a newspaper of general circulation in the municipal corporation or as provided in Ohio R.C. 7.16, notice of its intent to sell unneeded, obsolete, or unfit municipal property by internet auction. The notice shall include a summary of the information provided in the legislation and shall be published twice. The second notice shall be published not less than ten nor more than twenty days after the previous notice. A similar notice shall be posted continually throughout the calendar year in a conspicuous place in the offices of the Village's Fiscal Officer and the Council. If the Village maintains a website on the internet, the notice shall be posted continually throughout the calendar year on that web site.
   (d)   When property is to be sold by internet auction, Council or its representative may establish a minimum price that will be accepted for specific items and may establish any other terms and conditions for the particular sale, including requirements for pick-up or delivery and method of payment. This type of information shall be provided on the internet at the time of the auction and may be provided before that time upon request after the terms and conditions have been determined by Council or its representative.
   (e)   Items up for internet auction by the Village of Monroeville shall be advertised under the seller I.D. of Village of Monroeville.
   (f)   The Village Administrator or his/her designee shall be available by appointment for any consumer-related inspections related to the public sale.
   (g)   All communications with the successful buyer shall be in writing. Arrangements and costs associated with delivery of any item to the successful bidder shall be the sole responsibility of the purchaser. (Ord. 2019-23. Passed 11-12-19.)
