Pursuant to Ohio R.C. 721.15, the following shall be the procedure for the sale, transfer or disposal of personal property owned by the Village:
(a) Personal property not needed for municipal purposes, which in a Department Superintendent's opinion has an estimated value of less than $1000 (one thousand dollars), may be sold by any means and at a value deemed appropriate by the Village Administrator and approved by Council.
(b) If the estimated value of the property is more than one thousand dollars, it shall be sold only when authorized by an ordinance approved by Council. When so authorized, the Village Administrator shall make a written contract with the highest and best bidder after advertisement of not less than two nor more than four consecutive weeks in a newspaper of general circulation within the municipal corporation or as provided in Section 7.16 of the Ohio R.C. The form of the written contract is incorporated and attached hereto as "Exhibit A".
(c) When Council finds, by legislation, that the Village has vehicles, equipment, or machinery which is obsolete, or is not needed or is unfit for public use, and where the Village intends to purchase other vehicles, equipment or machinery of the same type, Council shall determine whether it is in the best interest of the Village that such unneeded or unfit vehicles, equipment or machinery be sold as a trade-in for the purpose of having such sale price credited against the purchase price of such other vehicles, equipment or machinery to complete the sale and purchase by a single contract to be approved by Council.
(d) If Council determines that the Village has personal property not needed for public use, or is obsolete or unfit for the use for which it was acquired, and that the property has no value, Council shall make the determination to discard or salvage that property.
