933.03 SCHEDULE “LP” LARGE POWER SERVICE.
   (a)   Availability: This Schedule is available to all Consumers located along existing electric distribution lines of Village (hereinafter referred to as Utility) who use Utility's Standard Service and who guarantee the Monthly Billing Capacity specified by Service Application (or Contract), but not less than 50 kVa.
   Where substation capacity in excess of 150 kVa is required to supply Consumer's existing and probable future requirements, Utility reserves the right to require Consumer to install the necessary complete substation equipment to take service at Utility's specified primary voltage and this Schedule "LP" shall apply. See elsewhere herein as to character of service, metering, voltages, discount applicable where Consumer furnishes complete specified substation equipment, etc.
   Service under this Schedule will be furnished only on a 12 months non-seasonal basis in accordance with the following stipulations, and also in accordance with Utility's General Rules and Regulations or subsequent revisions thereof which are a part of the Rate Schedule as if fully written herein.
   (b)   Net Rate per Month per Service or per Transformer Installation: The Total Monthly Billing shall be the sum of the charges (1), (2) & (3) calculated in the manner specified below:
      (1)   Service Charge:            $75.00 per month
      (2)   Capacity Charge:
                     
      For the first 5,350 kW of Billing Demand      $ 7.25 per kW
      For kW of Billing Demand over 5,350 kW                 *
  
              Per kVar of Reactive Demand              $ 1.00 per kVar
      (3)   Energy Charge:
      
         For the first 1,000,000 kWh         $ 0.075 per kWh
         For the next 1,500,000 kWh          0.070 per kWh
         For kWh over 2,500,000 kWh          **
*   The Capacity Charge for Billing Demands in excess of 5,350 kW will be based on Utility's incremental power supply related capacity costs associated with serving the load in excess of 5,350 kW, which shall include transmission and capacity related demand charges imposed by the Regional Transmission Organization (PJM), adjusted for losses. Consumer's obligation to pay Capacity Charges for Billing Demands in excess of 5,350 kW may extend beyond termination of service under this Schedule.
**   The Energy Charge for kWh in excess of 2,500,000 kWh will be based on Utility's incremental power supply related energy costs associated with serving the monthly usage in excess of 2,500,000 kWh, which shall include energy costs, transmission related energy charges and AMP service fees, adjusted for losses.
   All billings under the above rates shall be subject to the provisions hereinafter set forth, relating to Billing kWh and Metering, Determination of Monthly kW and kVar Billing Capacity, Power Supply Cost Adjustment, Discount For Furnishing of Substation by Consumer, Billing Where Multiple Transformer Banks Are Furnished, Monthly Minimum Charge, etc.
   (c)   Monthly Minimum Charge: The Monthly Minimum Charge Under this Schedule shall be not less than $7.25 per kW of Monthly Billing Capacity as hereinafter determined, plus the Service Charge of $75.00 per Month, nor less than the Minimum Charge specified in Consumer's Service Contract with Utility. Said Minimum Charge shall not be reduced by reason of application of the "Discount for Furnishing of Substation".
   There shall be added to the Minimum Charge, as determined above, any applicable Power Supply Cost Adjustment. Said adjustment shall be applied to the Billing kWh as hereinafter determined.
   The Minimum Charge is applicable on a 12-month year around basis and Seasonal Disconnects will not avoid the applicable Minimum Billing Capacity and resultant Minimum Charge, except as provided under (d) of "Determination of Monthly kW and kVar Billing Capacity".
   (d)   Determination of Monthly Kw and Kvar Billing Capacity: The kW and kVar Capacity (to nearest kW and kVar) shall normally be determined by measurements, using the highest 15 minute integrated or equivalent thermal kW and kVar capacity. The Monthly kVar Billing Capacity shall be equal to the highest measured kVar Capacity witnessed during the billing period, as determined herein.
   Where highly fluctuating or intermittent loads, welding machines, electric furnaces, hoists, elevators, X-ray, and the like are operated by the Consumer, Utility reserves the right to determine the kW Capacity by averaging Consumer's total load over a 2 minute period or by increasing the 15 minute measured maximum kW capacity in operation by the Consumer by 50% of the name plate rating in kVa of said fluctuating load equipment.
   Where such fluctuating loads require additional or separate transformers or additional system capacity, the measured kW Capacity as determined above shall be increased by 70% of the name plate rated kVa capacity of the separate transformer that serves such fluctuating loads.
   The kW Billing Capacity shall be determined as above, but in no event shall it be less than the highest kW as determined by any of the following methods, nor less than 50 kW:
      (1)   The Minimum kW Capacity specified by Utility and set forth in Consumer's Service Application or Contract with Utility. In specifying the Minimum Contract Capacity in kW, Utility will take into consideration the system capacity and companion investment required and/or reserved in order to adequately supply both the Consumer's initial and probable future requirements.
      (2)   Forty percent 40% of Highest kW Measured During the immediate preceding 11 month period.
      (3)   50% of the Total kVa Installed or Allocated Transformer Capacity used to supply Consumer's requirements - whether or not same is furnished by Utility or Consumer.
      (4)   For Service Furnished For Tax Supported Seasonal Activities, including athletic fields, fairs, etc. Utility reserves the right to waive the provisions set forth in (1), (2) and (3) above. In such an event, the Billing Capacity shall be the Measured Capacity but not less than the Contract Capacity nor less than 50 kW. For such Tax Supported Seasonal Service, each time that service is established the Minimum Billing period shall not be less than 4 consecutive months for athletic fields and 2 consecutive months for fairs and other events and, thereafter, the billing shall continue as long as service is connected. All such Seasonal Service is subject to Utility's Charge for each Reconnection and Disconnection of Service.
   (e)   Billing KWH & Metering: Utility reserves the right to meter all service at either Primary or Secondary voltage. For billing purposes Utility shall determine whether the metering is to be considered as being Primary or Secondary. If Utility defines the service as being metered at Primary voltage, for billing purposes the metered kWh will be multiplied by 0.95.
   (f)   Billing Where Multiple Transformer Banks Are Furnished: Service under this Schedule is based upon Utility furnishing all service at a single voltage through 1 transformer bank. Utility may, at its option, supply additional voltages through additional transformer banks.
   Utility reserves the right to meter multiple transformer banks at secondary voltage and to bill each transformer bank separately or to meter all service at Primary voltage. Where such multiple transformer banks are primary metered, a transformer rental charge of $0.40 per kVa of name plate rated transformer capacity of the additional transformer banks furnished by Utility will be made.
   The Minimum Billing Capacity where Multiple Transformer Banks are furnished shall be as specified under "Determination of Monthly kW and kVar Billing Capacity.
   (g)   Discount for Furnishing of Substation Equipment by Consumer:
      (1)   Where individual or unusual substation facilities are required to serve Consumer, or where the required transformer capacity is 150 kVa or more, Utility reserves the right to require Consumer to install, own and operate at his expense the necessary complete substation (consisting of transformer, structure, protective devices, etc.) required to utilize service at Utility's specified untransformed Primary Voltage delivered to Consumer's premises. The size, capacity and other Substation Specifications shall be determined by Utility and the entire installation shall conform to Utility's Specifications and Standards.
      (2)   Utility shall specify the Delivery Voltage of 4,160 or 12,500 volts required to adequately supply Consumer's initial and contemplated future electric power requirements, and Utility shall specify whether or not such Delivery Voltage is defined as Primary or Secondary Service and whether or not the Substation Discount and/or primary metering kWh multiplier of 0.95 shall apply.
      (3)   In the event that Utility determines the service to be furnished by Consumer is Primary Service and Consumer furnished the complete substation equipment, a Discount of $0.40 per kW of Billing Capacity shall apply. The resultant Discounted Bill shall not be less than the applicable Monthly Minimum Charge as determined herein or by Contract.
   (h)   Power Supply Cost Adjustment: The Rates and Charges set forth in this Schedule are subject to the Adjustments set forth in Utility's Rider "A" (Power Supply Cost Adjustment), except that the Power Supply Cost Adjustment shall not be applied to kWh in excess of 2,500,000 kWh per billing period.
   (i)   Terms of Payment: The above rates and charges are Net as shown and reflect the Discount allowed from the Gross Rates if all accounts due and payable are paid by the date specified on the bill. If not so paid, for current month billing the Gross Rates, which are 10% higher than the unpaid current month Net billing, shall be due and payable. Said loss of Discount shall be applied only once to any initial unpaid billing amounts.
   If any bill is not paid within the date specified, service shall be subject to Disconnection and, to partially pay for the additional expense involved, any Reconnection of Service shall be subject to the charges set forth in Utility's General Rules and Regulations.
   (j)   Other Terms and Conditions:
      (1)   Secondary Service will normally be supplied through a single set of service wires. The voltage shall, at Utility's option, be either 120/240 volt single phase 3 wire; or 120/208 or 277/480 volt, 3-phase, 4 wire. If the voltage requested is impractical for Utility to furnish, Consumer shall furnish at his expense such transformers as are necessary to deliver such voltage.
         As provided under "Discount For Furnishing of Substation Equipment By Consumer", Utility shall specify whether the service and/or metering voltage is Primary or Secondary.
      (2)   Single Billing: If all service is supplied through a single 3 or 4 wire service drop to a single meter location designated by Utility, a single bill will be rendered.
      (3)   Multiple Billing: If service is delivered through individual and separately metered single and 3-phase service drops, separate bills will be rendered for each meter.
      (4)   Multiple Service Requirements In Order to Qualify for Single Billing: If Consumer's wiring is rearranged at Consumer's cost so that all requirements can be supplied with a single 3 or 4 wire service drop from a single transformer bank to one meter location, a single bill will be rendered. In such an event, Utility reserves the right to use separate single and 3-phase meters, and to add the kW, kVar and kWh Meter Readings arithmetically.
      (5)   Transformer Capacity Limitations: If more than 150 kVa of transformer capacity or an unusual installation is involved, Utility may require Consumer to install the necessary complete substation, in which event the Substation Discount may apply. Installations in excess of 1000 kVa of transformer capacity shall require a special agreement which will set forth the rates, terms and conditions, etc. for such service.
      (6)   General Rules and Regulations: For further details as to the rights, responsibilities and obligations of both the Utility and Consumer, see Utility's General Rules and Regulations.
      (7)   Contract Provisions: A written Contract may be required to cover service furnished under this Schedule, the terms to depend upon investment required by Village, revenue to be received, etc. The Contract shall specify the Minimum Charge, the Minimum Billing Capacity, Contribution in Aid of Construction (if any), and related matters required to protect Utility's Investment and to secure payment of Consumer's accounts.
