Before a permit may be issued to make an excavation in the surface of an improved public street, alley, right-of-way or easement, the applicant shall deposit with the Village in addition to the fee provided for by Section 905.03, three hundred dollars ($300.00), to cover the cost of restoration by the Village. As soon as practicable after the completion of the work to be performed by the applicant, the Village shall repair the surface of the excavation restored by the applicant with paving material of quality equivalent to that removed by the excavation. In the alternative, the applicant may obtain permission from the Village for the applicant to repair the surface of the excavation with paving material of quality equivalent to that removed by excavation. If, after a period of sixty (60) days from the date of resurfacing of the excavation, it is determined by the Village Administrator or Street Superintendent that the opening has been adequately filled by the applicant, the Village shall refund to the applicant that portion of the amount advanced by him/her in excess of the cost of restoration, if made by the Village, or, the entire amount advanced by him/her, if restoration was made by the applicant.
