(a) No public or private utility shall trim or remove trees located within the public right-of-way within the Village of Monroeville, Ohio, without first obtaining written approval of the Village Administrator or Street Superintendent no less than seventy-two hours prior to the work taking place.
(b) The requirement for advance notice shall not be necessary in emergency service restoration work, when said emergency service restoration work is due to acts of God or acts of nature.
(c) Any public utility failing to provide advance notice prior to trimming or removing trees located within the public right-of-way within the Village of Monroeville, Ohio, shall be guilty of a minor misdemeanor, and upon being found guilty of such violation, shall be fined not less than one hundred dollars ($100.00). In addition, any unnecessary mutilation, injury or death of a tree as a result of negligent work, all cost associated with the repair or replacement of the tree(s) shall be charged to the person or firm performing said work.
