All carts operated on the streets of the City of Monroe must be inspected by the Monroe Police Department and issued a permit prior to operation. The inspection by the Chief of Police, or his/her designee, will cover the following safety requirements and every cart operating on City of Monroe streets must have the following safety equipment.
   (A)    Permits/stickers issued to operators/owners of golf carts by the Monroe Police Department.
   (B)   Each owner must have proof of ownership, and liability insurance, and a completed waiver of liability, releasing the City of Monroe, its employees, and affiliates from all liability that may arise as a result of operating a cart inside the City of Monroe. A current waiver of liability must be on file with the Monroe Police Department, and must be renewed annually, along with the permit.
   (C)   All carts must meet the requirements or minimum standards of safety equipment as set forth in § 78.02.
   (D)   All cart operators must present a valid driver’s license.
   (E)   Permits/stickers will be issued annually, and are valid from July 1st of each year. The following fees shall apply:
      (1)   Inspection by Police Department $10 annually (includes permit/sticker); and
      (2)   Re-inspection by Police Department $5 (if a cart fails the initial inspection).
   (F)   Lost or stolen permit/stickers are the responsibility of the owner. A police report must be filed in the event of a lost or stolen permit/sticker. The Chief of Police will have the discretion in determining whether a permit/sticker may be re-issued in this instance. If no record can be found of a previous application, or the receipt of a permit/sticker, the Chief of Police may direct the applicant to reapply, and also resubmit any and all fees necessary, before a replacement permit/sticker is issued.
   (G)   Any person who operates a cart in the City of Monroe and fails to receive and properly display a City of Monroe permit/sticker will be subject to all applicable state laws, in addition to being in violation of this chapter.
   (H)   Cart owners must complete the attached registration form, waiver of liability form and provide a copy of the proof of liability insurance prior to the cart being inspected. The completed forms and proof of insurance will be maintained by the Monroe Police Department.
