§ 156.140   BUILDING SETBACK REQUIREMENTS.
   (A)   No portion of any building may be located on any lot closer to any lot line or to the right-of-way line, whichever is more restrictive, than is authorized in the table set forth in this section.
   (B)   As used in this section, the term "building" includes any substantial structure which by nature of its size, scale, dimensions, bulk, or use tends to constitute a visual obstruction or generate activity similar to that usually associates with a building. Without limitation the generality of the foregoing, the following structures shall be deemed to fall within this description: Fences running along lot boundaries adjacent to public street right-of-way if such fences exceed six feet in height and are substantially opaque.
   (C)   Notwithstanding any other provisions of this chapter, a sign may be erected on or affixed to a structure that (i) has a principal function that is something other than the support of the sign (e.g., a fence), but (ii) does not constitute a building as defined in this chapter, only if such sign is located so as to comply with the setback requirement applicable to freestanding signs in the district where such sign is located.
   (D)   Gas pumps and overhead canopies or roofs shall have a 5 foot setback minimum from all public right-of-ways.
   (E)   With the exception of properties outlined in Subsections (F) and (G) of this section and §§ 156.132 and 156.98 of this chapter, setbacks from all property lines shall be a minimum of 10 feet from all right-of-ways.
   (F)   Minimum setbacks for properties within the Central Business District shall be all property lines.
   (G)   Properties having frontage along any of the following streets shall have a minimum of a 50 foot setback from all public right-of-ways:*
      (1)   Franklin Street.**
      (2)   Roosevelt Boulevard.
      (3)   Morgan Mill Road.
      (4)   Walkup Avenue.
      (5)   Olive Branch Road.
 
      (6)   Secrest Shortcut Road.
      (7)   Goldmine Road.
      (8)   ML King, Jr. Boulevard.
      (9)   Stafford Street.
      (10)   Old Charlotte Highway.
      (11)   Charlotte Avenue. **
      (12)   Lancaster Avenue.
      (13)   Griffith Road.
      (14)   Concord Avenue.
      (15)   Dickerson Boulevard.
      (16)   Fowler Secrest Road.
      (17)   Medlin Road.
      (18)   Pageland Highway.
      (19)   Rocky River Road.
      (20)   Secrest Avenue.
      (21)   Skyway Drive.
      (22)   Sutherland Avenue.
      (23)   Sunset Drive.
* Infill neighborhoods and conditional districts will have varying street setbacks according to §§ 156.132 and 156.98.
** Segments of Franklin Street and Charlotte Avenue are subject to the provision outlined in Subsection (F).
