(A) The Water Resources Director shall determine the form of and information required to be in applications. Each application shall be factually accurate and signed by both the person legally responsible for the proposed activity and by the design engineer. The applicant shall supply an address at which the applicant may be served with any papers or notices provided for by this. Service at this address is effective unless the applicant has given the City written notice of a change of address, after which service may be made at the new address.
(B) Persons desiring plan approval and the grant of a permit shall submit four (4) copies of fully executed and complete plans and specifications and application forms accompanied by the required application fee. An engineer's report shall be completed with each application and shall include appropriate references to City's Water System Management Plan.
(C) A nonrefundable application fee shall be established by the City Council.
(D) The design engineer shall certify, under professional seal, compliance with the City's standards in the project plans. Furthermore, upon completion and prior to operation, the design engineer shall submit a certification, under professional seal, that construction was completed in accordance with this chapter and in accordance with approved plans and specifications. This statement shall be based upon observations during and upon completion of construction by the engineer or a representative of the engineer's office who is under the engineer's supervision. For facilities with phased construction, additional certifications may be needed as follow-ups to the initial certification.
(E) All applications for permits shall be in writing. The Water Resources Director shall act on a permit application within thirty (30) days after the applicant submits a complete application containing all the information required by the Water Resources Director. The thirty-day period does not begin until a complete application is submitted. The Water Resources Director may conduct any inquiry or investigation deemed necessary before acting on an application, and may require an applicant to submit plans, specifications, and other information, appropriately sealed by the design engineer, considered necessary to evaluate the application.
(F) Permits shall be valid for twenty-four (24) months after issued date. A permit shall contain such conditions as the Water Resources Director determines to be reasonably necessary. The Water Resources Director's decision to grant, deny, or grant with conditions shall be based upon the design, capacity, and manner of operation of the City's sewer system or water distribution system; applicable rules, regulations, statutes, and ordinances of all governmental entities; and the City standards. Permits are not transferable. With respect to sewer systems, the Water Resources Director shall send notice of and a copy of each application for a permit to DENR, certificate of operation, and engineer's certification. The Water Resources Director shall send copies of approved permits and plans to DENR upon request. With respect to water distribution systems, the Water Resources Director shall send to DENR notice and a copy of each application, all approved plans, certificate of operation, and engineer's certification.
(G) The denial of an application for a permit or renewal shall be made in writing and shall state the deficiencies in the application indicating an estimate of the changes in the applicant's proposed activities or plans which will be required in order for the applicant to obtain a permit.
