(A) (1) Any person found to be violating any provision of this chapter shall be served by the town with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof.
(2) The offender shall, within the period of time stated in the notice, permanently cease all violations.
(3) Any person who shall continue any violation beyond the time limit provided for, shall be guilty of a class C infraction and, on conviction thereof, shall be fined in an amount not exceeding $500 for each violation. Each day in which any violation shall continue shall be deemed a separate offense.
(4) Any person violating any of the provisions of this chapter shall become liable to the town for any expense, loss or damage occasioned by the town by reason of the violation.

(B) Any person found to be violating any provision of this chapter shall be guilty of a misdemeanor. On conviction, the violator shall be punished for the first offense by a fine of not more than $500; and for the second offense by a fine of not more than $1,000; and for the third and each subsequent offense by a fine of not more than $1,000 to which may be added imprisonment for any determinate period not exceeding 90 days and, each day after the expiration of the time limit for abating insanitary conditions and completing improvements to abate the conditions as ordered by the County Board of Health or by the duly appointed Health Officer of the county shall constitute a distinct and separate offense.
