§ 95.01 DEAD TREES.
   (A)   All dead trees within the town are hereby declared to be a public nuisance, offensive to the sight and a peril to the safety of the life and property of the residents of the town.
   (B)   It shall be unlawful for any person to allow, suffer or permit any dead tree to remain standing upon or in the street adjacent to any lot or parcel of land owned or under the care, management or control of the person.
   (C)   (1)   The Clerk-Treasurer shall notify any person so owning or having the care, management or control of any lot or parcel of land where the dead tree is standing to remove the same within ten days from the date of receiving the notice and in the event the same is not removed, the town will cause the same to be removed at the expense of the person and the person shall be liable for removal costs and any penalties incurred.
      (2)   The notice shall be served personally upon the person by the Marshal or other employee of the town.
