§ 92.03 GARBAGE.
   (A)   The town shall provide garbage, trash and refuse collection for residents and those businesses that elect to do so by contracting with a private individual or firm for the service to be furnished on at least a year to year basis.
   (B)   The town shall advertise for bidders for the garbage service and may award a contract to the lowest and best bidder. The minimum terms of any contract awarded shall be one year, but may be extended to a term not to exceed five years. The successful bidder shall provide a performance bond for the amount of the annual cost of collection service for the duration of the contract.
   (C)   Residents and businesses of the town will be provided with collection of trash and garbage on a once a week basis to the extent that any resident's or business's trash or garbage does not stick out above the tote or exceed a weight of 40 pounds per bag. This service will be billed to the resident or business monthly. The current rate is $10.29 and will be $12.90 once new totes are provided. Effective January 1, 2024, the rate will increase to $13.40. To the extent that the aforesaid limit is exceeded, each resident or business will be individually liable for the cost of collection of the excess. There is an allowance of one bulky item per week. Mattresses, box springs and upholstered furniture must be wrapped in plastic to be picked up.
   (D)   Garbage and trash pick-up service will be provided at the curb or edge of the road or street running in front of each residence or business with the exception of houses and business located on Market Street, in which case pick-up will be made from the alley behind the houses and businesses. All trash or garbage is to be placed in the totes not exceeding the above-stated weight limitation and placed no nearer than three feet from the edge of the road, street or curb, and to be clearly visible to facilitate location and pick-up.
   (E)   The Town Council shall designate a day of the week during which collection is to be made and all trash and garbage shall be in place for pick-up not later than 7:00 a.m. on the collection day. All empty cans are to be promptly removed from the edge of the road, street or curb and by not later than 7:00 p.m. on the collection day.
   (F)   In addition to the trash and garbage limits established above, residents and businesses may place for pick-up limbs and shrubs not exceeding two inches in diameter and four feet in length, bundled in a bundle not to exceed 18 inches diameter and weighing no more than 75 pounds. Loose leaves, grass clippings, and loose branches and limbs will not be removed.
   (G)   Building materials which cannot be bagged or placed in cans within the limits set forth by this section will not be collected. Heavy rocks, cement and automotive parts will not be collected.
   (H)   Residents and businesses having excess trash or garbage over and above the limits set forth by this section may contact the town's trash contractor for collection or pick-up of the excess at the individual expense of the resident or business.
   (I)   Reserved.
   (J)   Residents and businesses who miss the time for pick-up may call the Town Hall, but the town shall have no responsibility for disposal of trash, garbage or refuse of residents or businesses that fail to comply with the terms of this section.
   (K)   The present use of burn barrels will be continued, but the owners or residents will be responsible for cleaning refuse or burnt residue from the barrels and bagging or placing the residue in rigid containers for collection by the contractor. The town will continue spring and fall clean-up of large articles as may be deemed necessary and reasonable by the Town Council, from time to time.
   (L)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      GARBAGE. Food waste and any other organic refuse of a similar nature.
      WASTE. All putrescible and non-putrescible wastes, including, but not limited to, garbage, household wastes, chemical compounds, industrial wastes, unused construction materials, building debris and all other materials which should properly and legally be disposed of at a state-approved landfill.
