§ 91.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   Any person violating the terms of § 91.01 commits a class B infraction and is subject to penalties as set forth in I.C. 34-28-5-4, as amended.
      (2)   Any burning permitted by 326 I.A.C. 1-8, as amended, shall not constitute a violation of § 91.01.

   (C)   Any person violating the terms of § 91.02 commits a class C infraction as defined by state law, I.C. 34-28-5-4, as amended.

   (D)   Any person violating any of the provisions of § 91.03 shall be subject to a fine in an amount of $50 for the first violation, payable at the Town Hall. Any subsequent violation shall subject the violator to a fine of up to $2,500 per violation. In addition to any fine and court costs, violators shall reimburse the town for the cost of responding emergency services, if any.
