3-2-5: POWERS AND DUTIES OF LOCAL LIQUOR CONTROL COMMISSIONER:
The commissioner shall have the following powers, functions and duties in addition to others set forth in this chapter:
   (A)   Accept and review original and renewal applications for liquor licenses and to approve or disapprove them. Applications may be approved only in strict accordance with this chapter and only if the city council has created a sufficient number of licenses in a particular classification.
   (B)   Receive license fees and forward the same to the city treasurer.
   (C)   Make or cause to be made, by the various city departments such investigations as may aid the commissioner in the performance of his or her duties.
   (D)   Recommend to the city council the approval or rejection of any request to create an additional liquor license in any licensing classification.
   (E)   Enter or authorize any law enforcement officer or peace officer to enter and inspect a licensed premises at any time.
   (F)   Receive complaints from any citizen that any applicable rules or regulations have been or are being violated and to act upon such complaints.
   (G)   Examine or cause to be examined under oath any original or renewal license applicant or any licensee upon whom notice of charges or notice to appear has been served. For such purposes the commissioner may issue subpoenas, which shall be effective in any part of this state. For the purpose of obtaining any information pursuant to this chapter, the commissioner may authorize an agent to act on his or her behalf.
   (H)   Suspend for not more than thirty (30) days or revoke any liquor license and/or impose an administrative penalty of not to exceed five thousand dollars ($5,000.00) for each violation. These penalties may be imposed only after notice and a hearing before the commissioner as set forth herein.
   (I)   Keep or cause to be kept a complete record of all licenses issued under this chapter with copies furnished to the city clerk, city treasurer, city collector, and police chief. Upon issuance of any license or the suspension or revocation of any existing license, the commissioner shall give written notice of such action to each of these officers within forty eight (48) hours of such action.
   (J)   Report to the city council all acts enforcing this chapter.
   (K)   Make and publish such other rules, regulations and forms as may be advisable to carry out the intent of this chapter. (Ord. 800, 10-5-2015)
