ORDINANCE NO. 885
AN ORDINANCE AMENDING LIQUOR LICENSES
WHEREAS, the City Council of the City of Momence, Illinois is charged with the continued administration and oversight of the City Code Book; and
WHEREAS, the City Council of the City of Momence, Illinois has established a liquor license ordinance; and
WHEREAS, the City Council of the City of Momence, Illinois has determined that the number of liquor licenses should be amended to allow the City of Momence, Illinois greater flexibility ; and
WHEREAS, the City Council of the City of Momence, Illinois wishes to amend the City Code, specifically under a portion of the Code known as Title 3, Chapter 2, Section 11, titled “NUMBER OF LICENSES”.
NOW, THEREFORE, be it ordained by the City Council of the City of Momence, Illinois, as follows:
SECTION 1: That Title 3, Chapter 2, Section 11, of the City Code of the City of Momence, Illinois, is hereby repealed.
SECTION 2: That there is hereby added to the City Code of the City of Momence, Illinois, in Title 3, Chapter 2, Section 11, titled “NUMBER OF LICENSES”.
3-2-11: NUMBER OF LICENSES:
The liquor control commissioner shall review all liquor license requests, and upon his/her approval, present his/her findings to the City Council. The City Council must approve each liquor request by a majority of the City Council.
No license of any class may be issued by the Commissioner unless the City Council has first adopted an ordinance creating a license of the class to be issued

Nothing herein shall prevent any establishment from obtaining multiple licenses of different classes for the purpose of combining the methods and means by which alcoholic beverages are sold.
SECTION 3:
The provisions and sections of this ordinance shall be deemed separable and the invalidity of any portion of this ordinance shall not affect the validity of the remainder.
SECTION 4: That this ordinance shall be in full force and effect after its passage, adoption, and publication as required by law.
