7-6-3-1: DEFINITIONS:
Unless the context specifically indicates otherwise, the meanings of the terms used in this section shall be as follows:
ACT: The federal water pollution control act and amendments of 1972, public law 92-500, adopted by the 92nd congress on October 18, 1972.
INDUSTRIAL COST RECOVERY: The recovery by the city from the industrial users of the treatment works of the grant amount allocable to the treatment of wastes from such users pursuant to section 204(b) of the act.
INDUSTRIAL COST RECOVERY PERIOD: That period during which the grant amount allocated to the treatment of wastes from industrial users is recovered from the industrial users of such works, which shall be a period of thirty (30) years.
INDUSTRIAL USER: Any nongovernmental user of publicly owned treatment works identified in the "Standard Industrial Classification Manual", 1972, office of management and budget, United States government, as amended and supplemented, under the following divisions: A, B, D, E and I.
A user in the divisions listed above may be excluded from this class if it is determined that it will introduce primarily domestic wastes or wastes from sanitary conveniences.
INDUSTRIAL WASTES: The wastewater discharges resulting from industrial, trade or business processes as distinct from their employees' domestic waste or waste from sanitary conveniences.
NONINDUSTRIAL USER: Any governmental or residential user of a publicly owned treatment works which introduces primarily segregated domestic waste or wastes from sanitary conveniences. The term also includes commercial, institutional and other industrial users where it has been determined that the waste contributed by these users is primarily segregated domestic wastes or waste from sanitary conveniences.
PROJECT: Project no. C170865 which is defined as a separate and distinct project for construction of the Momence municipal sewage works which was sponsored by the U.S. environmental protection agency under the provisions of public law 92-500. This project does not include past or future construction, equipment or other services not included under the specific project number and in the approved plans, specifications and change orders for the project.
RECOVERED AMOUNTS: The annual payments from industrial users for their shares of the federal grant allocable to the cost of treating industrial wastes, which is determined by dividing the total federal grant amount allocable to treatment of industrial waste by the industrial cost recovery period.
RETAINED AMOUNTS: Fifty percent (50%) of the amounts recovered from industrial users, together with interest earned thereon. (Ord. 181, 3-1-1976)
