5-4-4: REMOVAL; NOTICE; ABATEMENT:
It shall be the duty of the Chief of Police, or his designee, to serve or cause to be served, a notice upon the owner or occupant of any premises, or post notice on such premises on which weeds, grass, or plants are permitted to grow in violation of the provisions of this chapter. This shall also apply to the removal of garbage and debris, and the abatement of rodents and vermin. If the person in possession of the real estate so served has not cut the weeds, grass, plants, removed garbage and debris, or rodent and vermin abatement, within seventy two (72) hours, from the date of service, the City shall then proceed to abate such nuisance by cutting the weeds, grass, or plants, removing garbage and debris, and move forward with procedures to abate rodent and vermin. Upon the City's completion of the removal of the weeds, grass, plants, garbage, debris, or rodent and vermin abatement, the City shall determine the number of hours, with a minimum of one hour, spent in abating said nuisance, and the owner and occupant of the premises shall become and remain jointly and severally liable for repayment of the City's costs and expenses. Any person who violates this section is guilty of a petty offense as provided in this section and as established in the list of fines and fees in subsection 1-4-1(B) of this Code.
