5-2-15: APPREHENSION AND IMPOUNDING OF DOGS AND CATS NOT WEARING EVIDENCE OF INOCULATION:
Any dog found not wearing a current registration tag, and for which no current registration certificate can be produced; and any cat found not wearing a current inoculation tag, may be apprehended and impounded by the Momence police department or their authorized agent provided the Momence police department or their authorized agent have reason to believe such animal is four (4) months or more of age.
When a dog or cat is apprehended and impounded by the Momence police department pursuant to this section, he shall give notice of not less than seven (7) days to the owner, if known. Such notice shall be mailed to the last known address of the owner. An affidavit or testimony of the Momence police, or their authorized agent, who mails such notice shall be prima facie evidence of the receipt of such notice by the owner of such animal. In case the owner of any impounded animal desires to make redemption thereof, he may do so on the following conditions:
   (A)   He must present proof of current rabies inoculation and registration, if applicable, or
   (B)   He must pay for the rabies inoculation of the animal and registration, if applicable, and
   (C)   He must pay the pound for the board of the animal for the period it was impounded, and pay any charges specified in this chapter.
Any animal not redeemed by the owner which has been impounded for failure to be inoculated or registered in accordance with this section shall be humanely dispatched, offered for adoption, or otherwise disposed of by the pound as a stray animal in accordance with the laws that exist or may hereafter exist. Any person purchasing or adopting such animal with or without charge or donation must pay for the rabies inoculation, and registration, if applicable of such animal. (Ord. 725, 9-19-2011)
