3-2-6: APPLICATION FOR LICENSE:
   (A)   Application for a local retailer's liquor license, both original and renewal, shall be made to the commissioner. The application shall be in writing, upon forms provided by the commissioner. The application shall require such information as determined appropriate by the commissioner. Only fully completed forms shall be considered by the commissioner. Each original or renewal application shall be accompanied by the fee for the class of license applied for. The fees for licenses shall be as provided in section 3-2-12 of this chapter. Application for renewal of an existing license shall be submitted not less than thirty (30) days prior to expiration of the license, i.e., by April 1 of each year. If a fully completed renewal application and application fee is not received by the city by the date due, a penalty equal to one hundred fifty dollars ($150.00) shall be assessed against the applicant in addition to application and license fees.
   (B)   The application fee, license fee, and any applicable penalty, shall be paid in full upon submittal of an original or renewal license application. Upon issuance of any license, the licensee shall keep the information contained on the application current by furnishing to the commissioner, within thirty (30) days, written notice of any change in status regarding ownership, residency, management, or any other information set forth in the application.
   (C)   Before any license may be issued to an applicant, each person holding a five percent (5%) or more interest in the entity to be licensed and each designated manager (including the managing partner of a limited liability company) shall be fingerprinted by the Momence police department and the fingerprints sent to the appropriate law enforcement agency for a check of criminal history record information. An investigation will be performed to enable the commissioner to ascertain whether the issuance of a license will comply with all applicable regulations of the city. The commissioner may accept current fingerprints from another jurisdiction for persons not residing or working within fifty (50) miles of the city. The commissioner may require such documentation as deemed appropriate to determine actual ownership, and the commissioner's decision as to who shall be fingerprinted shall be final.
   (D)   The applicant must submit a certificate of insurance, which names the city of Momence as an additional insured, verifying that the principal has in effect at the time of the application dramshop or liquor liability insurance in the amount of one million dollars ($1,000,000.00). The certificate of insurance shall be subject to the approval of the commissioner.
   (E)   With any license application submitted for an original or renewal license to be effective May 1, 2016, or thereafter, the applicant shall include certificates of completion of BASSETT or TIPS training, as described in subsection 3-2-26(E) of this chapter, for each employee who will be engaged in serving alcoholic beverages, and for each person identified as a designated manager of the licensed premises.
   (F)   Each applicant shall at the time of application submit a surety bond to the city in the penal sum of one thousand dollars ($1,000.00) with sureties to be approved by the commissioner conditioned on the faithful performance of the provisions of this chapter and the laws of the state of Illinois and upon the payment of all fines and costs which may be assessed against the licensee for violation of any of the provisions hereof.
