11-2-5: APPLICABILITY:
   A. This chapter shall apply to all development in the village and contiguous unincorporated territory not more than one and one-half (11/2) miles beyond the corporate limits of the village and not included in any other municipality.
   B. Storm water detention in unsewered and separate sewered areas:
      1. Exemptions: Under the provisions of this section, storm sewer detention facilities meeting the criteria and requirements established herein are not required by the village for the following projects, provided, that the available outlet capacity is adequate. Detention as determined by the village engineer, will be required to store that portion of the runoff exceeding the outlet capacity.
         a. Residential subdivisions, the plats for which were recorded prior to January 1, 1972. If the subdivision or any part thereof is resubdivided, this exemption shall cease. When a permit application is made to the village pursuant to this exemption, the submittal must include a copy of the land plan and the plat of subdivision or resubdivision, as approved by the village. The land plan must show all the proposed layout and the intended use of the entire area involved. (Ord. 1630, 4-12-1999)
