10-5-4: FIRE DISTRICT CONTRIBUTIONS:
   As a condition of approval of any final plat of subdivision or planned unit development, subsequent to the effective date hereof, each subdivider or developer shall be required to dedicate cash for fire protection purposes, at the rate of one hundred fifty dollars ($150.00) per residential unit, prior to the time any building permit is issued for the same, to help serve the immediate and future needs of the residents of the development. Building permits for residential units in previously approved final plats of subdivision or planned unit developments shall not be subject to such dedication for fire protection purposes.
   A. Time And Manner Of Payment: The developer's or subdivider's contribution shall be made in full, to the fire protection district in which the property is situated (Mokena, Frankfort or New Lenox, as the case may be), prior to the issuance of building permits. A receipt will be issued by the appropriate fire protection district to evidence payment by the developer or subdivider. The receipt must be presented by the developer or subdivider to the building department as evidence that the fire protection district contribution has been paid pursuant to the terms of this section.
   B. Indemnity Of Village: As a condition precedent to the receipt of any funds by a fire protection district, said district shall execute and deliver to the village an indemnification agreement which specifically states:
      1. That the district agrees to reimburse the village in the event the village shall be required to refund any funds collected hereunder pursuant to the terms of this section.
      2. That the district agrees to pay all legal fees and expenses incurred in the event the legality of this section is litigated.
   C. Reservation Of Right: The village specifically reserves the right to rescind this section at any time or to compromise any claim brought against it as a result of its effect. (Ord. 1672, 10-25-1999)
