A. Adoption Of Code, Exceptions: The Village hereby adopts as its Building Code the 2018 International Building Code, first printing, as published by the International Code Council, with the additions, insertions, deletions and changes as herein set forth:
1. Section 101.1 Title. Delete words and punctuation marks, "(Name of Jurisdiction)" and in place thereof inserting the words "The Village of Mokena".
2. Section 101.4.3 Plumbing. Delete the words "International Plumbing Code" and "International Private Sewage Disposal Code" and replace with "2004 Illinois State Plumbing Code and local amendments thereto, and the Illinois Private Sewage Disposal Licensing Act and Code with the Will County Sewage Treatment and Disposal Ordinance".
3. Section 101.4.5 Fire Prevention. Delete the words "International Fire Code" and replace with "Fire Prevention Code as set forth in this title".
4. Section 101.4.6 Energy. Add the words 2012 Edition as prescribed by the State of Illinois after the words "Illinois Energy Conservation Code".
5. Section 104.6 Right of Entry. Add the following language:
The Building Official shall at its sole discretion have the authority to request the removal of visual obstructions in order to monitor and/or inspect work related to the enforcement of the provisions of this code. This includes, but is not limited to, the placement of observation openings in materials used to cover windows where work is being done.
6. Section 105.2 Work exempt from permit. Delete all items except items #7, 8, 9, 11, 12 and 13.
7. Section 111.2 Certificate Issued. Delete the words "that contains" and replace with "that may contain one or more of".
7.1 Section 113.1 Board of Appeals - General. Delete the words “Board of Appeals” and replace with “architectural and Site Plan Review Committee, “ as established in Village Code section 2-7-1
.
8. Section 114.4 Violation Penalties. Delete in its entirety and insert the following:
"Section 114.4 Violation Penalties. Any person who shall violate a provision of this Section or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the building official, or of a permit or certificate issued under the provisions of this Section shall be guilty of an ordinance violation punishable by a fine of not less than one hundred and fifty dollars ($150.00) nor more than seven hundred fifty dollars ($750.00). Each day that a violation continues shall be deemed a separate offense." Nothing herein contained shall be construed to prevent the village from taking such other lawful action as necessary or appropriate to prevent or remedy any violation, including, but not limited to the issuance of a stop work order.
9. Section 115.3 Unlawful Continuance. Delete this Section in its entirety and insert the following:
"Section 115.3 Unlawful Continuance. Any person who shall continue any type of work in or about the structure after having been served with a stop work order either oral or written, except such work as that person is directed to perform to remove or correct violations or unsafe conditions, shall be liable to a fine of not less than one hundred and fifty dollars ($150.00) nor more than seven hundred fifty dollars ($750.00). Each day or occasion that a violation continues and/or occurs shall be deemed a separate offense." Nothing herein contained shall be construed to prevent the Village from taking such other lawful action as necessary or appropriate to prevent or remedy any violation, including, but not limited to the issuance of a stop work order.
10. Section 202 Definitions. Delete The definition of HIGH-RISE BUILDING in its entirety and replace with the following language:
"A building having four or more stories used for human occupancy or located 50 or more feet above grade level."
11. Section 903.2 Where Required. Amend as follows:
A complete automatic fire suppression system shall be installed and maintained in full operating condition, as specified in this Code, in all buildings as follows:
All Buildings four (4) or more stories or fifty feet (50') in height.
In any building greater than seven thousand five hundred (7,500) square feet in floor area - inclusive of all floors, stories and mezzanines.
As required in locations indicated in Section 903.2.1 through 903.2.15 except as amended below:
12. Section 903.2.1.1 (1) Use Group A-1. Delete in its entirety.
13. Section 903.2.1.3 (1) Use Group A-3. Delete in its entirety.
14. Section 903.2.1.4 (1) Use Group A-4. Delete in its entirety.
15. Section 903.2.3 (1) Use Group E. Delete in its entirety. Delete the exception in this section in its entirety.
16. Section 903.2.4 (1) Use Group F-1. Delete in its entirety.
17. Section 903.2.7 (1) Use Group M. Delete in its entirety.
18. Section 903.2.8 Use Group R. Add the following language:
A building or structure, or portion thereof, used for sleeping purposes, when regulated by the International Residential Code as noted in Section 101.2 shall be exempt from the requirement to install an automatic sprinkler system.
19. Section 903.2.9 (1) Use Group S-1. Delete in its entirety.
20. Section 903.2.9.1 (1&2) Repair Garages. Delete in its entirety.
21. Section 903.3.1.1 NFPA 13 Sprinkler Systems. Add the language "and the Village of Mokena Fire Prevention Code" to the last line.
22. Section 903.3.1.2 NFPA 13R Sprinkler Systems. Add the language "and the Village of Mokena Fire Prevention Code" to the last line.
23. Section 903.3.1.3 NFPA 13D Sprinkler System. Add the language "and the Village of Mokena Fire Prevention Code" to the last line.
24. Section 905.3.1 Building Height. Delete items 1 through 3 and replace with the following language:
"Stand Pipe systems shall be installed at each level in all stairways of buildings exceeding two stories in height above the lowest level of fire department vehicle access and/or where the building exceeds two stories below the highest level of fire department vehicle access. All standpipe connections shall be 21/2" threaded fittings and shall be provided with 11/2" reducers and caps.
25. Section 907.2.1 Use Group A. Delete this Section in its entirety and replace with the following:
907.2.1 Use Group A. A fire detection system shall be installed and maintained in all buildings of Use Group A.
26. Section 907.2.2 Use Group B. Delete this Section in its entirety and replace with the following:
907.2.2 Use Group B. A fire detection system shall be installed and maintained in all buildings of Use Group B.
27. Section 907.2.4 Use Group F. Delete this Section in its entirety and replace with the following:
907.2.4 Use Group F. A fire detection system shall be installed and maintained in all buildings of Use Group F.
28. Section 907.2.7 Use Group M. Delete this Section in its entirety and replace with the following:
907.2.7 Use Group M and S. A fire detection system shall be installed and maintained in all buildings of Use Group M and S.
29. Section 1807 Foundation Walls, Retaining Walls and Embedded Posts and Poles; Section 1808 Foundations; Section 1809 Shallow Foundations; Section 1810 Deep Foundations:
Masonry-unit footings, Steel grillage footings, Timber footings, Wood foundations, Rubble Stone foundations, Hollow masonry walls, Pier and curtain wall foundations are to be avoided whenever possible and shall only be allowed with the specific approval of the Building Official.
30. Section 1807.1.6.1 Foundation Wall Thickness Delete in its entirety and insert the following:
The thickness of foundation walls shall be not less than the thickness of the wall that it supports for the various materials of construction as herein specified. In no case shall the foundation wall thickness be less than the wall being supported unless such foundation wall is of reinforced concrete. The minimum thickness shall be ten inches (10") for structures with masonry walls or brick-veneered and framed.
31. Section 1809.8 Plain Concrete Footings Delete in its entirety and insert the following:
In plain concrete, the minimum footing size shall be 20 inches in width and 10 inches in depth. For foundation walls wider than 10 inches, footings shall extend a minimum 5 inches beyond either face of the foundation wall and shall be a minimum 10 inches in depth.
32. Section 3001.2: delete this section in its entirety.
33. Section 3001.4: Add the following language "and the Illinois Accessibility Code (IAC)".
34. Section 3002.4 Elevator car to accommodate stretcher. Delete this section in its entirety and replace with the following:
Where elevators are provided in buildings, not fewer than one elevator shall be provided for fire department emergency access to all floors regardless of rise, unless specifically waived in writing by the Building Official.
Such elevator car shall be of such size and arrangement to accommodate a minimum 24 inch by 84 inch ambulance stretcher in the horizontal open position and shall be identified by the International Symbol for emergency medical services (Star of Life).
The symbol shall not be less than 3 X 3 inches high and wide (76mm X 76mm) and shall be placed inside on both sides of the main lobby hoistway door frame.
35. Section 3003.3 Standardized fire service elevator keys - add the following language:
"for new and modernized (existing) elevators only."
36. Section 3004.4 Personnel and material hoists. Delete the last sentence of this section and replace with the following:
Field tests shall be conducted upon the completion of an installation or following a jump or a major alteration of a personnel hoist. All miscellaneous hoisting and elevating equipment shall be subjected to tests and inspections as required by the Authority Having Jurisdiction to ensure safe operation.
37. Section 3005.1 Access. Add the following language to this section:
This means is not to be used as a passage way through the space to other areas of the building.
38. Section 3005.4 Machine Rooms. Delete exception #2 in its entirety.
39. Add new Section 3009 Certificate of Compliance.
3009.1 - The operation of all equipment governed by the provisions of this chapter and hereafter installed, relocated or altered shall be unlawful by persons other than the licensed installer until such equipment has been inspected and tested as herein required and a final certificate of compliance has been issued by the Authority Having Jurisdiction.
3009.2 - Posting Certificates of compliance: The owner or lessee shall post the current-issued certificate of compliance in a conspicuous place inside the conveyance. A copy of the current issued certificate is acceptable. Please refer to Illinois Elevator Safety Act.
