8-1-10: ENFORCEMENT:
   A. General: It shall be the duty of the building official, his duly authorized agent(s), and any lawfully appointed peace officers to enforce the provisions of this title. The building official is hereby empowered to make or cause to be made such inspections as may be necessary to see to the enforcement of these provisions, and to make or cause to be made any tests or examinations of materials or methods to be used, for the purpose of determining if they comply with the provisions of this title.
   B. Stop Order: The building official, or his duly authorized agent(s) shall have the power to order all work stopped on the construction, alteration or repair of buildings or site development in the village when such work is being done, in the sole discretion of such building official, in violation of any provision of this title or any zoning or other village ordinance. Such stop order, when oral, shall be followed by a written stop order within twenty four (24) hours. It shall be unlawful to continue work in violation of a stop order until the person issuing it has revoked such order.
   C. Unlawful Continuance: Any person who shall continue any work in or about the structure or site after having been served with a stop work order either oral or written, except such work as that person is directed by the building official to perform to remove or correct a violation or unsafe condition, shall be subject to a fine of not less than one hundred fifty dollars ($150.00) nor more than seven hundred fifty dollars ($750.00). Each day and/or occasion that a violation of this section shall continue shall constitute a separate offense.
   D. Violation; Penalties: Any person who shall violate a provision of this chapter or shall fail to comply with any of the requirements contained in this title or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the building official, or of a permit or certificate issued under the provisions of this chapter shall be guilty of an ordinance violation punishable by a fine of not less than one hundred fifty dollars ($150.00) nor more than seven hundred fifty dollars ($750.00). Each day that a violation continues shall be deemed a separate offense. Nothing herein contained shall be construed to prevent the village from taking such other lawful action as necessary or appropriate to prevent or remedy any violation. (Ord. 2008-O-005, 1-14-2008)
