8-1-8: LANDSCAPE PERMIT REQUIREMENT:
   A.   Landscaping Application: Prior to the landscaping of any new building, the property owner(s) must submit a detailed application showing, among other things:
      1.   First lot grading survey;
      2.   Location, type and size of any and all trees, shrubs, fencing, other landscaping amenities, grass areas and location of berms, drainage easements and swales, if applicable;
      3.   Location of underground sprinklers, if any (additional permit required for sprinkling systems);
      4.   Location of drain tiles, downspouts and sump pump discharge.
   B.   Landscaping Permit: The village will issue a landscaping permit to the property owner upon completion of the following:
      1.   Submittal of landscaping application in conformance with village ordinances and regulations;
      2.   Receipt and approval of the first lot grading survey;
      3.   Payment of a security deposit in the sum of one thousand five hundred dollars ($1,500.00) to ensure all landscaping/second lot grading survey will be completed within six (6) months of the date of the issuance of the landscaping permit. If the applicant has previously submitted a one thousand five hundred dollar ($1,500.00) landscape guarantee deposit to the village, this deposit may replace, and serve the function of, the security deposit for the landscape permit.
   C.   Time To Complete Landscaping: All landscaping must be completed within six (6) months of the date of the issuance of the permit. The village community development director is authorized, at his/her sole discretion, to extend the permit date up to an additional six (6) months based on the circumstances related to the completion of the landscaping.
   D.   Failure To Timely Complete Landscaping/Second Lot Grading Survey: If all landscaping and the second lot grading survey are not completed within the required time, the one thousand five hundred dollar ($1,500.00) landscape guarantee deposit shall be considered forfeited by the property owner/applicant to the village without any further action on the part of the village. Forfeiture of the landscape/second lot grading survey guarantee deposit or the security deposit shall not constitute a waiver of any other legal rights or remedies available to the village as set forth herein or that may be available to the village at law or in equity.
   E.   Deposit Refund/Certification: If the landscaping/second lot grading survey is timely completed, the village will return the one thousand five hundred dollar ($1,500.00) landscape guarantee deposit to the property owner/applicant, without interest. At the time of request for and prior to any refund, the property owner(s) shall submit to the village for approval the second lot grading survey by a registered land surveyor or a registered professional engineer.
