4-1-1: NUISANCES ENUMERATED:
It is hereby declared to be a nuisance for any person within the limits of the village to engage in, create, cause, allow to exist, encourage, cause or help to cause any of the following acts or conditions set forth in this section, all of which are hereby defined as nuisances. It shall be unlawful for any person: (1983 Code; amd. Ord. 2008-O-005, 1-14-2008)
   A.   To cause or suffer the carcass of any animal or any offal, filth or noisome substance to be collected, deposited or to remain in any place, to the prejudice of others.
   B.   To throw or deposit any offal or other offensive matter, or the carcass of any dead animal in any watercourse, lake, pond, spring, well or common sewer, street or public highway.
   C.   To corrupt or render unwholesome or impure the water of any spring, river, stream, pond or lake, to the injury or prejudice of others.
   D.   To obstruct or impede, without legal authority, the passage of any navigable river or waters.
   E.   To obstruct or encroach upon public highways, private ways, streets, alleys, commons, landing places, and ways to burying places.
   F.   To carry on the business of manufacturing gunpowder, nitroglycerin, or other highly explosive substances, or mixing or grinding the materials therefor, in any building within twenty (20) rods of any valuable building erected at the time such business may be commenced.
   G.   To erect, continue or use any building or other place for the exercise of any trade, employment or manufacture, which, by occasioning noxious exhalations, offensive smells or otherwise, is offensive or dangerous to the health of individuals, or of the public.
   H.   To advertise wares or occupation by painting notices of the same on, or affixing them to fences or other private property, or on rocks or other natural objects, without the consent of the owner, or if in the highway or other public place, without permission of the proper authorities.
   I.   To harass, intimidate or threaten any person who is about to sell or lease or has sold or leased a residence or other real property or is about to buy or lease or has bought or leased a residence or other real property, when the harassment, intimidation or threat relates to a person's attempt to sell, buy or lease a residence or other real property, or refers to a person's sale, purchase or lease of a residence or other real property.
   J.   To allow water to accumulate and remain in a pond or ponds either wholly or partly within the limits of any private property for a period of more than ten (10) consecutive days. For the purpose of this section, the term "pond" shall be considered to mean any exposed surface of water not less than one hundred (100) square feet in area which has accumulated either by natural or artificial means, in any depression or connected series of depressions or depressions of excavations, whether existing naturally or created artificially.
   K.   To allow any person to throw or drop a cup, plate, trash, paper, waste, refuse, garbage, litter or container upon private or public sidewalks, crosswalks, roadways, property or any part of any public street or alley.
   L.   To own, use or keep any horses, mules, cattle, sheep, goats, swine or domestic fowl of the species of geese, ducks, turkeys, hens or barn fowl, guinea fowl, peacocks, pigeons or bees within the village limits, except when specifically allowed by ordinance.
   M.   To permit the growth upon any premises of any noxious weeds, such as jimson, burdock, ragweed, thistle, cocklebur and like weeds 1 .
   N.   To cause or suffer grass, leaves, underbrush or other combustible matter to be collected, deposited or to remain on his premises in such quantities and in such condition as to materially increase the danger to property of others from forest or other fires.
   O.   To permit the growth upon any premises of any poplar or cottonwood trees as herein defined. A "poplar tree" is hereby defined as any of a genus of slender quick growing salicaceous trees also known as populus. A "cottonwood tree" is hereby defined as a tree of the poplar group with a cottony comma investing the seeds, also known as Populus balsamifera.
   P.   To permit or maintain an unsightly yard or premises where there is an accumulation or deposit of any vehicle, equipment, household furniture such as refrigerators, stoves, washing machines, or waste material of any nature; to maintain an unsightly yard or area where wrecked or disabled automobiles, trucks or equipment, or other such matter is allowed to accumulate.
   Q.   To use, operate or maintain any housecar or trailer for human habitation upon any lot or plat of ground within the limits of the village, except in a duly licensed trailer camp.
   R.   To commit any offense which is a nuisance according to the common law of the law of the land or made such by the statutes of the state. (1983 Code)
   S.   To permit or maintain an unsightly yard or premises where there is an accumulation or deposit of discarded and unwanted putrescible and nonputrescible household and kitchen wastes, including, but not limited to, food, food residues, and materials necessarily used for packaging, storing, preparing, and consuming same, usually defined as "garbage"; and all combustible and noncombustible waste materials resulting from the routine of domestic housekeeping, including, but not limited to, aluminum and steel cans, glass containers, plastic containers, medical waste generated as general household waste, metal, paper of all types, including newspapers, books, magazines and catalogs, boxes and cartons; cold ashes; furniture, furnishings, and fixtures; textiles and leather; dead animals and animal waste; toys and recreational equipment; and similar items.
   T.   To wilfully make or assist in the making of any loud, intensive, repetitive, unnecessary or unusual noise or noises, caused by any horn, bell, radio, loudspeaker, vehicle, motorcycle, dirt bike, recreational activity, or other instrument or activity. (Ord. 2008-O-005, 1-14-2008)
   U.   To allow any garbage/recycling/landscape waste containers to be stored other than in, behind, or alongside of the principal or accessory building on a lot in a neat and orderly fashion.
   V.   To allow a garbage/recycling/landscape waste container to be placed at the curb for collection sooner than five o'clock (5:00) P.M. the evening prior to collection day or later than seven o'clock (7:00) P.M. on collection day. (Ord. 2014-O-015, 4-28-2014)
