§ 50.13 VEHICLE REQUIREMENTS; COVERING AND SPILLAGE; IMPOUNDING.
   (A)   All garbage or rubbish transported on the streets or other public thoroughfares in the village shall be in proper containers, the bodies of which are leak proof and of easily cleanable construction and shall be completely covered with metal. No permit shall be issued for any motor vehicle which is not so equipped.
   (B)   Spillage or drainage from permitted vehicles shall be considered a misdemeanor. It shall be a violation of this chapter for any person or permit holder to spill or drain garbage and/or rubbish or cause to have garbage and/or rubbish spilled or drained, anywhere within the village. The individual responsible for such drainage or spillage, and his/her employer or his/her contractor, shall have full logistical and financial responsibility for the immediate cleanup of such spillage or drainage.
   (C)   No permit shall be issued for any motor vehicle which is not equipped with an adequate covering, such as a tarpaulin or other suitable material, such covering to effectively prevent materials collected therein from blowing from or falling off the motor vehicle. No permit shall be issued for any motor vehicle whose bed, body or containers thereon are not properly constructed to prevent the dropping or leaking of the materials collected therein or thereon.
   (D)   No driver of any motor vehicle or truck hauling rubbish, garbage, refuse, waste products or scrap material shall fail to have the load covered with a tarpaulin, canvas or other suitable covering so as to prevent the contents of the motor vehicle or truck from blowing, spilling or scattering on the streets and alleys of the village.
   (E)   Any motor vehicle permitted in accordance with this chapter and subsequently found by the Police Department not to be in compliance with the requirements of this chapter may be impounded. In such case, the permit holder shall be ordered to comply with such requirements. Upon the permit holder's failure to do so, the Clerk-Treasurer, upon recommendation of the Police Department, may revoke the permit holder's permit.
