§ 50.10 PERMITS; FEE.
   (A)   No person shall collect from residential units or commercial operators or transport garbage or rubbish within the village, unless possessing a valid, unrevoked permit. Only one permit at a time can be issued by the village for residential units. Multiple permits at a time can be issued by the village for commercial operators. A permit shall be issued by the Clerk-Treasurer only upon payment of the applicable annual fee, as determined by the Director of Public Service, and only after the Village Police Department has determined that the permittee can comply with the requirements described herein. The village's contractor must also adhere to the performance bond specifications as set forth in the village's contract.
   (B)   Whoever desires a permit hereunder shall make written application at the Village's Municipal Building. The written application must be made on the form provided, correctly stating the following information:
      (1)   Name, address and telephone number of applicant;
      (2)   Make, model and current registration license number of any motor vehicle used in the business;
      (3)   A brief description of the type of materials to be collected;
      (4)   The applicant's business name, address and telephone number;
      (5)   The name, address and telephone number of each principal owner of the applicant;
      (6)   Type of business/permit sought (commercial operators or residential units);
      (7)   Location of site for disposing of solid waste and recyclables;
      (8)   If for commercial operators, a list of customers for whom the applicant is currently providing with solid waste and/or recycling collection services.
   (C)   The application for a permit shall be transmitted to the Mogadore Police Department and a qualified member thereof shall inspect each motor vehicle listed on the application to ascertain if the vehicle is in safe operating condition and has equipment thereon to meet the requirements of R.C. Chapter 4513 for operational safety for the type of motor vehicle being inspected. Vehicles are required to be inspected annually.
   (D)   The results of the inspection shall be endorsed upon the application by the examining officer. If the results are satisfactory, and upon payment by the applicant of a permit fee of $100 for each such motor vehicle to be operated within the village, the Clerk-Treasurer shall issue to the applicant a permit, valid from the date of issuance to March 1 of the following year, together with a license identification to affix to each motor vehicle. During the period of validity of the permit, the license identification shall be displayed upon each motor vehicle in an unobscured, conspicuous place. The permit fee above described shall be collected for the purpose of reimbursing the village for the cost of processing the permit application and performing necessary vehicle inspections.
   (E)   Each commercial operator permit holder shall be required to post with the village a $500 cash or surety bond to insure the faithful performance of duties and responsibilities required of it under this chapter and ordinances regulating vehicular traffic in the village, as well as trash and recyclable collection and transportation.
   (F)   Each permit holder shall conspicuously place or cause to be placed on each refuse truck operated in the village the company name and telephone number, as stated on the permit, in the letter size of not less than six inches in height. Additionally, there shall also be displayed on each vehicle the village permit number in numbers not less than four inches in height.
   (G)   A certificate of insurance in the amount of $1,000,000 combined single limit (combined bodily injury and property damage) per accident is hereby required to each permit holder.
