(A) Fermenting, putrefying or odoriferous garbage or refuse in containers or dumped in the open is hereby declared to be a nuisance and the person responsible therefore shall be guilty of violating this section.
(B) When rubbish has been set out in a proper container awaiting collection and removal from any premises, no person shall scavenge or remove any rubbish or part thereof, except with the consent of the owner, occupant, or lessee of such premises.
