§ 50.03 COLLECTION AND DISPOSAL DEEMED A PUBLIC UTILITY.
   (A)   The system of collection and disposal of garbage and rubbish by the village is hereby declared to be a public utility. The services provided in this chapter shall be rendered to all persons upon compliance with all regulations pertaining to such utility.
   (B)   Each permit holder as described in this section shall provide weekly collection of solid waste and recycling services.
   (C)   Residential pickup of solid waste, garbage, rubbish, recyclables and yard waste is hereby limited to Tuesdays, Wednesdays and/or Thursdays. No garbage and/or rubbish collector shall collect and/or dispose of rubbish within the village between 9:00 p.m. and 6:00 a.m. the following day.
   (D)   Each residential unit (and thus a subscriber) and commercial operators are hereby required to secure solid waste services from a permit holder as provided herein.
      (1)   Mandatory residential subscriptions. All residential units within the village who utilize any garbage and/or rubbish collections and disposal service shall subscribe to the garbage and rubbish collection service of the village's contractor.
      (2)   Permissive commercial subscriptions. All commercial operators within the village who utilize any garbage and/or rubbish collections and disposal service may only subscribe to the garbage and rubbish collection service of a properly permitted solid waste hauler.
