§ 70.98 VIOLATIONS.
   (A)   Effective immediately, the offenses listed in division (B) below may be satisfied and resolved by the execution of a guilty plea, a waiver of court appearance and a payment to the village of the sums set forth for the various offenses listed. This waiver system shall be subject to the citing officer's permission to so pay the fine. If the officer stipulates that the defendant must appear in Mayor's court, then the waiver system specified herein shall not be available to a defendant. The utilization of the traffic fine waiver system shall be subject to all rules and regulations promulgated by the Mayor in connection with the conduct and operation of the Mayor's court, and the fines set forth in division (B) below shall be paid pursuant to such rules and regulations.
   (B)   Bond schedule.  
      (1)   There is hereby established the following schedule with respect to bonds which may be required of defendants.

      (2)   In traffic misdemeanors when a case has more than one count, the applicable bond shall be on the count with the highest bond.
   (C)   Mayor's court costs. All state-mandated costs shall be paid with each case number. This amount is currently $34 on each “moving violation” case number, but is subject to immediate change should the State of Ohio mandate a higher cost per case. Local court costs are $46 per case. Of the total amount collected as court costs per case number and retained by the village, the sum of $9 shall be paid to the “Alcohol and Chemical Substance Education and Prevention Fund”, to be used only for the purpose of educating children and adolescents regarding alcohol and chemical substance abuse and traffic safety. As used herein, a “moving violation” has the same meaning as set forth in R.C. § 4510.01(E).
   (D)   Minor Misdemeanor Violation Bureau schedule.
      (1)   Pursuant to Traffic Rule 13 of Title 45 of the Ohio Revised Code, it is hereby ordered that effective immediately, persons upon whom minor misdemeanor citations, notices or summonses have
been served by any lawfully authorized police officer may, within seven days after the date of issuance of such citation, notice or summons, at their option:
         (a)   Appear personally at the Violation Bureau, sign a guilty plea and waiver of trial provision and pay the total fine as listed in Exhibit A of Ordinance 36, passed June 7, 2007, or
         (b)   Sign the guilty plea and waiver of trial provision and mail a check, money order, or certified check for the total fine to the Violation Bureau.
      (2)   A remittance by mail of the fine to the Minor Misdemeanor Violation Bureau shall constitute a plea of guilty and waiver of trial whether or not the guilty pleas and waiver of trial provisions are signed by the defendant. Any traffic waiver eligible for disposition in the Minor Misdemeanor Violation Bureau, which is mailed to and received by the Bureau, may be accepted by the Bureau so long as a warrant has not been issued on that traffic citation.
   (E)   Waiver schedule. The schedule listed in Exhibit A of Ordinance 36, passed June 7, 2007, shall constitute the fines which shall be paid to the Violations Bureau by those eligible for waiver.
