§ 150.207 NEW UTILITY OCCUPATION WITHIN THE RIGHT-OF-WAY.
   (A)   Permit application.
      (1)   Submit a Planning Commission application to Village Clerk (with fees and deposit).
      (2)   Submit neat drawings of proposed work (see sample plans).
      (3)   New utility occupation within the village R/W must be approved by the Planning Commission and Council.
      (4)   If approved by the Planning Commission, the application will automatically be referred to Council.
      (5)   For new utilities, the Village Engineer cannot approve the right-of-way permit until the Planning Commission and Village Council have approved the occupancy.
      (6)   Include a traffic control plan for the work. This may be a flagger for curbside work in low traffic areas up to a detour plan for more significant impacts on busier streets.
      (7)   Roadway crossing or utility connection drawings must show all utilities and storm sewers in the area of interest.
      (9)   Linear projects and utility extensions/replacement require plan and profile drawings showing all utilities and storm sewers.
      (10)   Many concrete roads within the village have plastic storm drains under or just behind the curb. These drains must be avoided and protected at all times.
      (11)   For mailbox installations, refer to the village mailbox installation detail to prevent damage to storm drains.
      (12)   Include OUPS reference number on application.
   (B)   Village fees.
      (1)   Planning Commission application fee and right-of-way permit application fee and deposit required.
      (2)   Deposits are required to cover direct costs to the village and provide money for the village to correct sub-standard or incomplete work. Refer to the Village Permits and Approvals Fee Schedule for application and deposit fees.
      (3)   Deposits may be increased by the village for complicated or larger projects.
      (4)   Unused deposits as determined by the village will be returned upon the village's approval of the work.
   (C)   Village standards.
      (1)   The contractor perforating excavations within the village is required to contact OUPS, OGPUP, 811 or individual utilities as required to locate and protect underground facilities. Record drawings are not exact and care should be used when excavating near utilities shown on plans or marked in the field. The village should be contacted directly for the location of storm sewers.
      (2)   The contractor performing work within the village is responsible for worker and public safety. Compliance with 29 CFR 1926 Subpart P and OSHA excavation requirements are the responsibility of the contractor performing the work.
      (3)   See the village standard roadway drawings for roadway, apron and driveway construction requirements.
      (4)   It is recommended that contractors reference the village standard details before quoting the proposed work.
      (5)   The contractor must perform traffic control in accordance with the Ohio Manual of Uniform Traffic Control Devices (supplemented as needed to provide clear and safe direction to drivers). The proposed traffic control shall be accepted by the village prior to the work.
      (6)   The contractor shall coordinate with the village emergency dispatch regarding daily changes in the traffic patterns. Contact Village Hall at 330-628-4896 for the current dispatch phone number.
      (7)   Work on busy roads or bus routes may be restricted to certain hours of the day.
      (8)   The contractor shall not track materials onto village roadways. If required, village street sweeping will be charged back to the owner through the deposit.
      (9)   To mitigate pollution due to run-off, the contractor shall provide inlet protection and silt fence as directed by the village.
      (10)   Issues that are not immediately and appropriately addressed by the contractor will be addressed by village forces. The cost of which shall be deducted from the deposit.
      (11)   Disturbed areas shall be repaired with a minimum of three inches of screened topsoil, a high quality residential seed mix, mulching and watering/fertilizer as needed to ensure full germination within 60 calendar days.
   (D)   Inspections.
      (1)   Periodic inspection by the Village Engineer.
      (2)   Provide the village 48 hour (two business days) notice of work to allow scheduling of inspection.
      (3)   Storm system construction/connection inspection required.
      (4)   Backfill inspection required.
      (5)   Pre-pour inspection for asphalt or concrete roads at a minimum.
      (6)   Inspection of doweling of concrete pavement required.
      (7)   Inspection during pavement placement possible.
