§ 93.51 NOTICE TO OWNER TO CUT NOXIOUS WEEDS, HIGH GRASS; SERVICE.
   (A)   Upon written information that noxious weeds are growing on lands in the village and are about to spread or mature seeds, the Zoning Inspector or his designee shall cause notice to be served on the owner, lessee, agent, or tenant having charge of such land, notifying him or her that noxious weeds are growing on such lands and that they must be cut and destroyed within five days after service of such notice.
   (B)   Written notice of the violation shall be posted at the offending property and the village shall send said notice by regular U.S. mail to be served upon the owner, lessee, agent or tenant having charge of such land, at the tax mailing address for said property. If the address of the owner or other person having charge of the land is unknown it is sufficient to publish the notice once in a newspaper of general circulation in the county. Only one notice per calendar year for violations of this section is required for a lot or parcel. If, after notice has been served in accordance with this division, the village determines that a subsequent violation has occurred, the village may proceed with the remedies contained within these sections.
   (C)   In the instance of unoccupied property or vacant land the village, in lieu of a mailed notice, may post the property by affixing a notice to the building or in the instance of vacant land a notice may be affixed to a stake, tree, or fence. This notice shall contain the day of posting and the location of the property. Such weeds or other growth must be cut or destroyed within five days after receipt of such notice.
   (D)   This section does not apply to land being used under a municipal building or construction permit or license, a municipal permit or license, or a conditional zoning permit or variance to operate a junkyard, scrap metal processing facility, or similar business, or a permit or license issued pursuant to R.C. Chapter 3734, R.C. §§ 4737.05 through 4737.12, or R.C. Chapter 6111.
