§ 151.002 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. Words used in singular include the plural. Words used in present tense include the future tense.
   BUILDING SETBACK LINE. A line establishing the limits of a yard which abuts a street and in which no building may be located.
   CASH BOND. See PERFORMANCE GUARANTEE.
   CONTRACTOR. The contractor is the developer or any person, firm or corporation undertaking the construction of any or all phases of the work contained in this chapter.
   CUL-DE-SAC. A local street having one end open to vehicular traffic and the other end permanently terminated by a vehicular turn around.
   DEAD-END-STREET. A street temporarily having only one outlet for vehicular traffic and intended to be extended or continued in the future.
   EASEMENT. A grant of the use of land for a specific purpose.
   EMERGENCY ORDINANCE. An ordinance usually acted on immediately with only one reading and taking effect after the earliest period allowed by law.
   IMPROVEMENTS. Includes, but is not limited to, grading, sanitary and storm sewers, water mains, pavement, curbs and gutters, sidewalks, street signs, streetlights, street trees, and the appropriate appurtenances required to render land suitable for the use proposed.
   INSPECTIONS. See § 151.082.
   LAND USE AND THOROUGHFARE PLAN. Mapped and/or written proposals for the future development of the area.
   LOT, CORNER. A lot at the point of intersection of and abutting on two intersecting streets.
   LOT, DOUBLE FRONTAGE. A lot, other than a corner lot, that abuts more than one street.
   LOT LINES. The boundaries of a lot.
   LOT, PARCEL. A division of land separated or proposed to be separated from other division of land by description on a recorded subdivision plat, recorded survey map, or by metes and bounds for purposes of sale, lease, or separate use.
   MINOR SUBDIVISION. A division of a parcel of land along an existing public street or road, not involving the opening, widening, or extension of any street or road, and involving not more than five lots after the original tract has been completely subdivided.
   MONUMENTS. Permanent concrete or iron markers used to establish definitely all lines of the plat of a subdivision, including all lot corners, boundary line corners, and points of change in street alignment.
   ORIGINAL TRACT. A parcel of land as shown on the Portage and/or Summit County Tax Map Records.
   PEDESTRIAN WALKWAYS. A dedicate public right-of-way limited to pedestrian use.
   PERFORMANCE GUARANTEE OR BOND. An agreement by a subdivider or developer with the village for the amount of the estimated construction costs guaranteeing the completion of physical improvements according to plans and specifications within the time prescribed by the subdividers agreement.
   PLANNED UNIT DEVELOPMENT. An area of land in which a variety of housing types and/or related commercial and industrial facilities are accommodated in a pre-planned environment under more flexible standards, such as lot sizes and setbacks, than those restrictions that would normally apply under these regulations. The procedure for approval of such development contains requirements in addition to those of the standard subdivision, such as building design principles and landscaping plans.
   PLANNING COMMISSION OR COMMISSION. The Village of Mogadore Planing Commission.
   PLAT. A map prepared by a registered survey or of all or a portion of a subdivision which, if approved, may be recorded.
   PRELIMINARY PLAN. A drawing prepared by a registered survey or for the purpose of study of a major subdivision and which, if approved, permits proceeding with the preparation of the final plat.
   PRIVATE SURVEY PLAT. A map of one or more parcels of land, prepared by a registered surveyor, for the purpose of providing information necessary or incident to the transfer of said parcels in cases not requiring the platting of said parcels.
   PUBLIC UTILITY. Any person, firm, corporation, governmental agency, or board having a public utility commission permit to furnish under regulations to the public, electricity, gas, steam, telephone transportation or water, or any other similar public utilities.
   REGIONAL LAND USE PLAN. A plan showing the proposed location of uses in the region.
   SECRETARY. Secretary of the Planning Commission.
   SHALL is mandatory and MAY is permissive.
   SIDEWALK. That portion of the road right-of-way outside the roadway four feet or more in width which is improved for the use of pedestrian traffic.
   STAFF. Persons so designated by the Commission.
   STREET. A public or private right-of-way for vehicular and pedestrian use.
   SUBDIVIDER. Any individual firm, association, corporation, trust, or any legal entity, including agents commencing proceedings under this chapter to subdivide land.
   SUBDIVISION. The division of any parcel of land shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites, or lots, any one of which is less than five acres for the purpose, whether immediate or future, of transfer of ownership, provided, however, that the division or partition of land into parcels of more than five acres not involving any new streets or easements of access, and the sale or exchange of parcels between adjoining lot owners, where such sale or exchange does not create additional building sites, shall be exempted; or the improvement of one or more parcels of land for residential, commercial, industrial structures or groups of structures involving the division or allocation of land for the opening, widening, or extension of any street or streets, except private streets serving industrial structures; the division or allocation of land as open spaces for common use by owners, occupants or lease holders or as easements for the extension and maintenance of public sewer, water, storm drainage, or other public facilities.
   VARIANCE. A modification of the strict terms of the relevant regulations where such modifications will not be contrary to the public interest and where owing to conditions peculiar to the property and not the result of the action of the applicant, a literal enforcement of the regulations would result in an extraordinary and unnecessary hardship.
   VICINITY MAP. A drawing located on the preliminary plan or plat which sets forth by dimensions or other means, the relationship of the proposed subdivision or use to other nearby developments or landmarks and community facilities and services within the village in order to better locate and orient the area in question.
   WORK, THE. All work specified herein or indicated on the plans of the contemplated improvement covered by these regulations and supplemental agreements thereto.
