(A) Any and all construction, alteration, movement, enlargement, replacement, repair, location, maintenance, removal and demolition of structures within the village shall be regulated by the County of Summit Building Code, as set forth in Part Thirteen of the Codified Ordinances of Summit County (hereinafter "County of Summit Building Code"). The following regulations and codes, as adopted by and through the County of Summit Building Code, shall apply within the village:
(1) The construction, alteration, movement, enlargement, replacement, repair, maintenance, removal and demolition of all one-, two- and three-family dwelling residential buildings and structures, any appurtenances connected or attached thereto and any accessory structures, subject to the exceptions therein, shall be governed by the 2006 Residential Code of Ohio for One, Two and Three-Family Dwellings ("RCO"), as amended.
(2) The construction, alteration, movement, enlargement, replacement, repair, maintenance, removal and demolition of every other building or structure not governed by division (A)(1) of this section, any appurtenances connected or attached thereto and any accessory structures, subject to the exceptions therein, shall be governed by the 2007 Ohio Building Code of Ohio ("OBC"), as amended.
(3) Any residential and/or commercial code requirements in addition to those set forth in divisions (A)(1) and (A)(2), above, that are lawfully adopted by the County of Summit in the County of Summit Building Code.
(B) The County of Summit Department of Community and Economic Development, Division of Building Standards, shall serve as the Building Inspector/Building Official of the village, and shall regulate and enforce, pursuant to a written agreement between the village and the County of Summit, the construction, alteration, movement, enlargement, replacement, repair, location, maintenance, removal and demolition of all structures within the village by enforcing the regulations set forth in the County of Summit Building Code, and all other Codes adopted pursuant to and through the County of Summit Building Code. Furthermore, the County of Summit Building Code, including but not limited to the permitting and inspection processes and requirements and the fee schedule contained therein, shall govern said regulation and enforcement.
(C) The provisions of divisions (A) and (B), above, shall apply throughout the entirety of the village, regardless of whether the building being regulated is located in Summit or Portage County.
(D) Any amendments made to the County of Summit Building Code, or to any of the Codes adopted thereto, including any future versions of any RCO or OBC, shall be adopted and incorporated herein immediately upon the adoption of said amendments.
(E) All appeals to any decision made by the County of Summit Department of Community and Economic Development, Division of Building Standards shall be governed by any process for said appeals set forth in the County of Summit Building Code.
